N. Prothro, Z Leon L. Deaton, X Raymond M. Myers, Alderme n George D. Fox, V. R. Smitham, City Manager W. E. McBroom, City Clerk Thelbert Martin, City Attorney The Minutes of the previous meeting were read and approved. Moved by Alderman Prothro that the local post of the American Legion be allowed to use the auditorium for charity benefits at the rate of $25.00 per night. Motion seconded by Alderman Deaton and carried. Moved by Alderman Deaton that the application of the Continental Oil Company for a permit to move its gasoline service station from Front and Indiana Streets to the northwest corner of 12th and Holliday Streets, being Block 251, Original Townsite, be received and a public hearing be held at 7:30 P.M. Decenber 4, 1933 for the purpose of hearing protests. Yotion seconded by Alderman Myers and carried. Moved by Alderman Deaton that the Mayor be authorized and instructed to withdraw our application to the Federal Public Works Administration for funds to construct project No. 2, known as connecting ditch between the Water Improvement District's canal at Call Field and the irrigation system east of HollidEq Creek. Motion seconded by Alderman Myers and carried. Moved by Alderman Deaton that we adopt the CWA work pro- jects in the order in which they have been recommended by the citizens advisory committee of which W. M. McGregor is Chairman; said projects being: j 291 1. Changing Holliday Creek channel. 2. Conservation canal connecting Call Field irrigation ditch with the irrigation system east of Holliday Creek. Intercepting canal on the north side of Lake Wichita. Relocation and rebuilding of storm sewer east end of Scott Avenue. Motion seconded by Alderman Myers and carried. Moved by Alderman Myers that the Treasurer be instructed to transfer the sum of $2,379.89 from the General Fund to the Library Fund to cover overdraft in the Library Fund on Apri 4/ 193 3 due to delinquent taxes. Motion seconded by Alderman Prothro and carried. ORDINANCE NO.1143 AN ORDINANCE MAKING IT AN OFFENSE TO DrTM]T1 TRASH, REFUSE, DEBRIS, DEAD ANIMALS, TIN CANS, WORN OUT AUTOMOBILES AND WASTE MATERIAIS OF ANY KIND OR CHARACTER UPON THE BANKS OR IN THE BED OF THE WICHITA RIVER WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, FIXING A PENALTY, AND DECLARING AN MTERGENCY. Moved by Alderman Myers that Ordinance No. 1143 be passed on its first reading. Motion seconded by Alderman Deaton and carried by the follow- ing vote: Yeas: Aldermen Myers, Deaton, Prothro, and Fox. ORDINANCE-NO.1144 AN ORDINANCE AMENDING SECTIONS 1, SECTION 3, PARAGRAPH (d), SECTIONS 4, 5, PARAGRAPH 4, SECTION 6, PARAGRAPH 7, SECTION 7, PARAGRAP 3, SECTION 8, 9, PARAGRAPH 1 AND t9, SECTION 10, PARAGRAPH 5, SECTION 11, PARAGRAPH 1 AND SECTION 14, PARAGRAPH 1, OF ORDINANCE NO. 538, PASSED AND APPROVED ON THE 15TH DAY OF SEPTEMBER, A. D. 1924, ENPITLED "AN ORDINANCE CREATING THE OFFICE OF ELECTRICAL INSPECTOR, REGUIIATIN('. Moved by Alderman Myers that Ordinance No. 114J be passed on its second reading. Motion seconded by Alderman Deaton and carried by the following vote: Yeas: Aldermen Myers, Deaton, Fox, and Prothro. Nays: None. ORDINANCE NO.1142 AN ORDINANCE REQUIRING ALL PUBLIC UTILITIES WWHICH HAVE HERETOFORE OWNED AND HELD AND WHICH NOW OWN AND HOLD FRANCHISES TO USE THE STREETS, ALLEYS, AND PUBLIC WAYS OF THE CITY OF WICHITA FALLS AND TO ERECT THEREIN POLES, WIRES, STREET RAILROAD TRACKS, RAILROAD TRACKS, AND OTHER APPLIANCES AND EQUIPMENT, INCLUDING TELEPHONE, TELEGRAPH POLES, WIRES, PIPE, TIES AND RAILS AT THE EXPIRAT ON OF SUCH FRANCHISE AND/OR WHEN ANY SUCH LINES, POLES, PIPE, WIRES AND/OR RAILS ARE NOT BEING USED, TO REMOVE SAME FROM SUCH PUBLIC WAYS AND TO PLACE SAME IN GOOD CONDITION; AND WHERE SALE ARE IMBEDDED AND/OR CONSTRUCTED IN AND ON STREETS AND ALLEYS WHICH ARE PAVED, TO PAVE -1HE SPACE SO OCCUPIED BY SUCH POLES, TRACKS AND/OR PIPE WITH THE SAME KIND AND CHARACTER OF PAVING AS THAT USED IN THE BALANCE OF THE STREET AND ALLEY AND/OR TO COVER SAME WITH ASPHALT AMID/OR SOME OTHER APPROVED PAVING MATERIAL; ALL SUCH WORK TO BE DONE TO THE SATISFACTION OF AND STMJECT TO THE APPROVAL OF THE CITY ENGINEER, GIVING AND GRANTING TO THE CITY OF WICHITA FALLS A FIRST LIEN UPON ANY AND ALL SUCH MATERIALS SO REMOVED AND IN PLACE TO SECURE THE PERFORM".AIDE OF THE CONDITIONS HEREOF AND PROVIDING THAT SUCH MATERIALS SHALL NOT BE REMOVED FROM THE CITY OF WICHITA FALLS UNTIL SUCH WORK IS DONE IN ACCCRDffCE WITH THE PROVISIONS OF THIS ORDINANCE; PROVIDING THE CITY I AY REMOVE SUCH PrILES, TRACKS AND/OR PIPE AND HOLD AM/OR SELL SAME TO SATISFY ITS CLAIM? Moved by Alderman Fox that the City adopt as a matter of policy the regular legal procedure in securing Right -of -Way for reloca- tion of Highway #5 through the city and proceed by condemnation to se- cure such lots on which no- agreement can be reached as to the amount of damage. Motion seconded by Alderman Prothro and carried. Moved by Alderman Deaton that the meeting be recessed subject to call of the Mayor. Motion seconded by Alderman Prothro and carried.
