Min 11/20/19331286 Wichita Falls, Texas Memorial Auditorium Building November 20, 1933 The Board of Aldermen of the City of Wichita Falls met in regular session on the above date with the following members presen t: Raymond M. Myers, Mayor Pro Tem George D. Fax, I J. N. Prothro, ) Aldermen Leon L. Deaton, X V. R . Smitham, City Mane, ger W. E. McBroom, City Clerk Thelbert Martin, City Attorney The Minutes cf the previous meeting were read and approved. Moved by Alderman Prothro that Oscar Wilkes be authorized to move three gasoline storage tanks from 300 Barwise to a new location on Lot 13, Block 1, Sibley -Taylor Addition. Motion seconded by Alderman Deaton and carried. Moved by Alderman Deaton that C. Dibble be granted a license to operate a dance hall for colored people at 107J- Barwise. Motion seconded by Alderman Prothro and carried. Moved by Alderman Deaton that the City Manager be author- ized to invest accumulated sinking funds of term bonds in City of Wichita Falls bonds maturing before the term bonds'at present market pri ces. Motion seconded by Alderman Fox and carried. Moved by Alderman Prothro that Mayor Pro Tem Raymond M. Myers be authorized to execute the following maintenance agreement with the State Highway Department. Motion seconded by Alderman Deaton and carried. The City of Wichita Falls, State of Texas, hereafter referred to as Wichita Falls, and the Texas State Highway Depart- ment, hereinafter referred to as the Highway Department, hereby agree as follows: 1. That the Highway Department will submit a project for the improvement of 1.258 miles of the Municipal (N.R.M.-119 and N.R.M.-3) highway from loth Street to West City Limits, known as Scott Street Route, and to be designated as Texas project No. N. R.M. -119 and N. R.M. -3, and will recommend its approval by the Secretary of Agriculture for construction with funds apportioned to the State under Section 204 of the National Industrial Recovery Act; subject, however, to the condition that the City of Wichita Falls, Texas, shall provide for its proper maintenance after com- pletion of its improveme rt.. 2. That the said City of Wichita Falls, Texas, hereby requests the Highway Department to submit the of cr ement i oned project with recommendation that it be approved by the Secretary of Agriculture, and agrees that if such project is approved and constructed by the Highway Department and the Secretary of Agriculture it thereafter, at its own cost and expense, will maintain the project in a manner satisfactory to them, or their authorized representatives, and will make ample provision each year f or such maintenance. IN WITNESS WHEREOF, the parties have hereunto affixed their signatures, the City of Wichita Falls, Texas, on the 20th day of November, 1933, and the Highway Department on the day of 1933. adopted. RESOLUTION WHEREAS, the State Highway Department of the State of Texas is desirous of constructing State Highway No. 5 from loth Street to West City Limits through the City of Wichita Falls over Scott Street Route; and, WHEREAS, the State Highway Department is desirous of receiving Federal Aid for the improvement of said highway; and, WHEREAS, the Bureau of Public Roads of the Department of Agriculture of the United States of America will not participate in the construction of said highway until and unless the City of Wichita Falls will agree to refrain from permitting encroachments upon the right-of-way of said above mentioned streets, and until and unless the City of Wichita Falls will agree to refrain from passing ordinances or laws fixing a speed lim of tinder twenty miles per hour on said above mentioned streets, and until and unless the City of Wichita Falls will agree to refrain from erecting signs, semaphores, and signals that will give preference to local routes or that will hinder or delay traffic on said above mentioned streets. THEREFORE, be it resolved by the Board of Aldermen of the City of Wichita Falls that, for and in consideration of the State Highway Depart- ment of the State of Texas and the Bureau of Public Roads of the Depart- ment of Agriculture of the United States of America constructing said Highwsy No. 5 from loth Street to West City Limits through the City of Wichita Falls over Scott Street Route it hereby agrees with the State Highway Department of the State cf Texas and the Bureau of Public Roads of the Department of Agriculture of the United States of America that it will not, in the future, permit encroachment on the right-of-way of said above mentioned streets; nor will it pass an ordinance or laws fixing a speed limit on the above mentioned streets of under twenty miles per hour; nor will it allow the erection of signs, semaphores, and signals that will give preference to local routes which intersect with said abov mentioned streets nor that will slow up, hinder, or delay traffic on said above mentioned streets; nor will it repeal or amend any of the provision of this resolution without the consent of the State Highway Commission. ORDINAME NO 1142 AN ORDINANCE REQUIRING ALL PUBLIC UTILITIES WHICH HAVE HERETOFORE OWNED AND HELD AND WHICH NOW OWN AND HOLD FRANCHISES TO USE THE STREETS, ALLEYS AND PUBLIC WAYS OF THE CITY OF WICHITA FALLS AND TO ERECT THEREIN POLES, WIRES, STREET RAILROAD TRACKS, RAILROAD TRACKS, AND OTHER APPLIANCES AND EQUIPMENT, INCLUDING TELEPHONE, TELEGRAPH POLES, WIRES, PIPE, TIES AND RAILS AT THE EXPIRATION OF SUCH FRANCHISE AND/OR WHEN ANY SUCH LINES, POLES, PIPE, WIRES AND/OR RAILS ARE NOT BEING USED, TO R-U'OVE SAYE FROF SUCH PUBLIC WAYS AND TO PLACE SAME IN GOOD CONDITION; AND WHERE SAME ARE IMBEDDED AND/OR CONSTRUCTED IN AND ON STREETS AND ALLEYS WHICH ARE PAVED, TO PAVE THE SPACE SO OCCUPIED BY SUCH POLES, TRACKS AND/OR PIPE WITH THE SAME KIND AND CHARACTER OF PAVING AS THAT USED IN THE BALANCE OF THE STREET AND AI:LEY AND/OR TO COVER SAME WITH ASPHALT AND/OR SOME OTHER APPROVED PAVING MATERIAL; ALL SUCH WORK TO BE DONE TO THE SATISFACTION OF AND SUBJECT TO THE APPROVAL OF THE CITY ENGINEER, GIVING AND GRANTING TO 9HE CITY OF WICHITA FALLS A FIRST LIEN UPON ANY AND ALL SUCH MATERIALS SO REMOVED AND IN PLACE TO SECURE THE PERFORMAP'CE OF THE CONDITIONS HEREOF AND PROVIDING THAT SUCH MATERIALS SHALL NOT BE RKUIOVED FROM THE CITY OF WICHITA FAILS ITNITIL SUCH WORK IS DONE IN ACCORDANCE WITH THE PROVISIONS OF THIS ORDI- NANCE; PROVIDING THE CITY MAY REMOVE SUCH POLES, TRACKS AND/CR PIPE AND HOLD AND/OR SELL SAME TO SATISFY ITS CLAIM FOR REPAIRS OF STREETS, ALLEYS AND PUBLIC WAYS; PRESCRIBING A PENALTY; AND DECLARING AN EFERGEITCY .
