Item 1 - Call to Order City of Wichita Falls City Council Meeting Minutes July 7, 2020 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8.30 o'clock a.m., with the following members present. Stephen L. Santellana DeAndra Chenault Tim Brewer Jeff Browning Steve Jackson Michael Smith Bobby Whiteley Darron Leiker Kinley Hegglund Marie Balthrop - Mayor - Mayor Pro Tern - Councilors - City Manager - City Attorney - City Clerk Mayor Santellana called the meeting to order at 8.30 a.m. Item 2a — Invocation Pastor Ken Holsberry, Tenth & Broad Church of Christ, gave the invocation. Item 2b — Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. Item 3-5 — Consent Agenda 8:33 a.m. City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Browning to approve items on the consent agenda. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 3 — Approval of minutes of the June 16, 2020 Regular Meeting of the Mayor and City Council Item 4a — Resolution 60-2020 Resolution authorizing the City Manager to approve new Raw and Potable Water Purchase Contracts and Lease Agreement with the Wichita Valley Water Supply Corporation. Item 4b — Resolution 61-2020 Resolution authorizing the City Manager to approve a new Potable Water Purchase Contract with the Red River Authority of Texas. Item 5 — Receive Minutes (a) Wichita Falls Metropolitan Planning Organization Technical Advisory Committee, January 16, 2020 (b) Landmark Commission, February 25, 2020 Mayor Santellana moved to item 7a at this time. Item 7a — Resolution 62-2020 8:34 a.m. CITY COUNCIL MINUTES July 7, 2020 Page 2 Resolution approving the programs and expenditures of the Wichita Falls Economic Development Corporation (4A) by amending the budget to include up to $2,800,000 for Panda Biotech related to their proposed purchase and operation out of the former Delphi Plant on 1-44. Moved by Councilor Chenault to approve Resolution 62-2020. Motion seconded by Councilor Browning. Wichita Falls is one of three cities being considered by Panda Biotech. Discussion was held on the industrial hemp industry, the hemp decorticating process, products and uses of hemp, details of the proposal, and the timeline for the location decision. Motion carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 6a — Public Hearing 2020-2024 Consolidated Plan and 2020 Annual Action Place for CDBG and HOME funding allocations 9:05 a.m. Public Hearing to receive public comments concerning the proposed 2020-2024 Consolidated Plan and 2020 Annual Action Plan to allocate FY 2020 Community Development Block Grant (CDBG) funds in the amount of $1,246,504, and FY 2020 HOME Investment Partnership Program (HOME) funds in the amount of $440,347. Mayor Santellana opened the public hearing at 9:06 a.m. Terry Floyd, Director of Development Services, discussed the requirements for a Public Hearing for the 2020-2024 Consolidated Plan and the 2020 Annual Action Plan for regulatory compliance with HUD, and provided an overview of both plans. Katie Sellers, consultant with KSBR, LLC, discussed the plan submission requirements, available funds, eligible activities, eligibility requirements, fair housing act, various demographic and housing information for Wichita Falls, and the goals and projects supported by the funding. There were no additional comments from the public. Mayor Santellana closed the public hearing at 9:31 a.m. No action was taken. CITY COUNCIL MINUTES July 7, 2020 Page 3 Item 6b — Public Hearing and Ordinance 39-2020 9:32 a.m. Public hearing and consideration to rezone +/- 20.77 acres of land located at 300 Loop 11 (Flavis & Loreene Greer Subdivision, Lot 1-C, Block 1) and abutting right-of-way from Multi Family Residential (MFR) to General Commercial (GC) to facilitate the expansion of the existing multi -story assisted and independent living facility; and amending the Land Use Plan from High Density Residential and Institutional to Commercial. Mayor Santellana opened the public hearing at 9:32 a.m. Terry Floyd, Director of Community Services, discussed the application to rezone property located at 300 Loop 11 and the abutting right-of-way from Multi -Family Residential to General Commercial. The Planning and Zoning Commission recommends approval of the rezone. There were no additional comments from the public. Mayor Santellana closed the public hearing at 9:37 a.m. Moved by Councilor Brewer to approve Ordinance 39-2020. Motion seconded by Councilor Jackson and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 6c — Public Hearing and Ordinance 40-2020 9:38 a.m. Public hearing and consideration to rezone +/- 1.16 acres of land located at 4400 Kemp Boulevard (Faith Village Subdivision, Section 3, Lot 1-A, Block 74) and abutting right-of- way from Limited Commercial (LC) to General Commercial (GC) to allow for the expansion of land uses and construction of a shopping center with drive through services; and amending the Land Use Plan from Light Commercial to Commercial. Mayor Santellana opened the public hearing at 9:39 a.m. CITY COUNCIL MINUTES July 7, 2020 Page 4 Mr. Floyd discussed the application to rezone property located at 4400 Kemp Boulevard and the abutting right-of-way from Limited Commercial to General Commercial. The Planning and Zoning Commission recommends approval of the rezone. There were no additional comments from the public. Mayor Santellana closed the public hearing at 9:43 a.m. Moved by Councilor Chenault to approve Ordinance 40-2020. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 6d — Ordinance 41-2020 9:43 a.m. Ordinance amending the Fiscal Year 19-20 budget in an amount of $325,000 for the creation of fixed base operator services at Wichita Falls Regional Airport. Moved by Councilor Chenault to approve Ordinance 41-2020. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 6e — Ordinance 42-2020 9:49 a.m. Ordinance amending Section 102-108b Altered Prima Facie Speed Limits of the Code of Ordinances of the City of Wichita Falls, to Codify speed zone changes. Moved by Councilor Brewer to approve Ordinance 42-2020. Moved by Councilor Chenault to approve Resolution 63-2020. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 7c — Resolution 64-2020 9:55 a.m. Resolution authorizing the City Manager to award bid and contract for the 2020 Denver EST Roof Replacement Project to Pittsburg Tank & Tower Maintenance Co. Inc., in the amount of $650,526.00. Moved by Councilor Brewer to approve Resolution 64-2020. Moved by Councilor Chenault to approve Resolution 65-2020. Motion seconded by Councilor Jackson and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 8a — Staff Report — COVID-19 Update — Lou Kreidler, Health Director 10:02 a.m. Lou Kreidler, Director of Health, read an email from Phyllis Cowling, CEO of United Regional, regarding the number of hospitalizations, bed capacity, and other COVID related topics at the hospital. Ms. Kreidler stated that Monday was our highest number of hospitalizations in one day. Since the last Council meeting on June 16t" they have reported 346 cases, with cases being in the double digits every day since June 18tn The positivity rate has risen from 1.4% to 13.1 % with 43% of the total cases being between the ages of 20-39. 35% of cases are from community spread, 29% are contacts to a previous case, 24% are from close contacts with a household member. There have been very few travel related cases. The Health Department has contracted with eleven case managers and two Spanish interpreters and continues to hire additional case managers. She urged the community to understand we have community spread and they should take the proper precautions when in public including wearing masks in accordance with Governor's Order GA-29. Ms. Kreidler reminded citizens that to be effective masks must be worn appropriately covering both the nose and mouth. Wichita County had the third COVID related death this week and an all-time high of hospitalizations. If the public does not start taking personal responsibility by wearing a mask in public, avoiding social gatherings to include those with extended family, and staying home when they are ill, we will continue to see the number of cases rise exponentially. We all have the responsibility to protect one another. Councilor Jackson asked where citizens could obtain a test at no cost. Ms. Kreidler said free testing is not available, but the Community Health Center does provide income based testing and individuals that need assistance can contact the Health Department. CITY COUNCIL MINUTES July 7, 2020 Page 7 Councilor Smith discussed a newspaper article regarding an app for phones to assist with contact tracing, and asked if there are currently any apps we could use. Ms. Kreidler stated those apps are currently in the development stages and the state is working on an app. To be truly effective everyone would need the app on their phone and some individuals have concerns about apps like this. There was brief discussion on the rise in cases, if that is due to increased testing and the turnaround time to receive test results. Councilor Browning asked about bed capacity in the hospital and if there is any concern at this time. Ms. Kreidler discussed the fluctuating number of hospitalizations and stated she would contact Ms. Cowling to discuss bed capacity. Councilor Smith asked what Ms. Kreidler felt was attributing to our spike in cases. Discussion was held concerning the lack of social distancing, individuals not wearing masks, and social gatherings including church attendance. Councilor Jackson asked about an email regarding Castaway Cove and if there have been any cases from there. Ms. Kreidler stated they have not had a cluster of cases from Castaway Cove. Mayor Santellana discussed the need to wear masks when social distancing cannot be maintained and the recent order from Governor Abbott regarding outdoor gatherings of more than 10 people. He encouraged citizens to wear masks, social distance, and use hand sanitizer. Councilor Jackson asked if individuals in the hospital are quarantined to a certain area. Ms. Kreidler stated that there is a dedicated COVID wing, and the Emergency Room is split into COVID and non COVID areas with certain staff assigned to each area. Item 8b — Items of concern to members of the City Council 10.25 a.m. Councilor Browning congratulated the Chamber of Commerce on trying to get Panda Biotech to choose Wichita Falls. He discussed the Governor's mask mandate and encouraged citizens to wear masks not only for the health of everyone but also so businesses do not have to close if cases keep increasing. Councilor Smith thanked all of the individuals that work in jobs that have not stopped throughout the pandemic. He discussed the Confederate monument in front of Memorial Auditorium and stated that he feels like it is something the Council needs to address, encouraged other Councilors to think about placing it on the next agenda, and the possibility of adding it to the November election. CITY COUNCIL MINUTES July 7, 2020 Page 8 Councilor Whiteley discussed the positive news from 4A and the Chamber and gave kudos to those that have worked on the project. He asked about utility billing payments since lifting the grace period. Mr. Leiker stated that most individuals have paid but they continue to work with those that have been unable to pay and directing them to social agencies that can assist. Councilor Whiteley asked about acreage on Southwest Parkway, mowing regulations, and concerns regarding grass fires on this property. There was discussion regarding the mowing regulations and whether the property in question is inside city limits. Councilor Chenault said good morning, thanked everyone for attending or watching the live feed, and thanked the City and Sheppard Air Force Base for the fireworks show over the weekend. Mayor Santellana discussed the mask requirement, the need for individuals to wear masks in order to avoid further shutdowns, and enforcement issues. He discussed the outdoor gathering permits and that if cases continue to increase we will begin to discuss denying permits if needed. In regards to the Confederate monument, if other Councilors are interested in placing this item on the agenda reach out to Councilor Smith. Thank you to Sheppard Air Force Base for putting on the fireworks show safely. We are still in budget season with the preliminary budget out by July 15t". Councilor Jackson asked if with reduced sales tax due to the shutdown if we still estimate a $5 million shortfall in the General Fund. Mr. Leiker stated that yes we do although sales tax is one component. Hotel occupancy tax is down and we are looking at a large subsidy to the MPEC since they have not been able to operate. We are still waiting on the certified appraisal roll, and there have been a large number of protests this year. Item 9 — Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda 10.40 a.m. E.A. Jackson, 1809 Las Cruces Lane, addressed the council to give his opinion on confederate monuments on public land, and his desire to see the monument removed. Mr. Jackson read the letter he sent to the editor of the Times Record News to the Council. Item 10 — Executive Sessions 10.47 a.m. CITY COUNCIL MINUTES July 7, 2020 Page 9 City Council went into Executive Session at 10:47 a.m. in accordance with Texas Government Codes 551.087 and 551-074. Council reconvened at 11:26 a.m. Mayor Santellana announced that no votes or polls were taken.
