Item 1 - Call to Order City of Wichita Falls City Council Meeting Minutes April 21, 2020 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 10.00 o'clock a.m., with the following members present. (Virtual Meeting) Stephen L. Santellana DeAndra Chenault Tim Brewer Jeff Browning Steve Jackson Michael Smith Bobby Whiteley Darron Leiker Kinley Hegglund Marie Balthrop - Mayor - Mayor Pro Tern - Councilors - City Manager - City Attorney - City Clerk Mayor Santellana called the meeting to order at 10.00 a.m. Item 2a — Invocation Marie Balthrop, City Clerk, gave the invocation. Item 2b — Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. Item 3-4 — Consent Items 10:03 a.m. City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Chenault to approve items on the consent agenda. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 3 — Approval of minutes of the April 7, 2020 Regular Meeting on the Mayor and City Council Item 4a — Resolution 42-2020 Resolution accepting the Wichita Falls Transit System Title VI Civil Rights Program to meet grant assurances required by the Federal Transit Administration Item 4b — Resolution 43-2020 Resolution authorizing the purchase of one mowers through the BuyBoard Purchasing in the amount of $53,891.40 Item 5a — Ordinance 22-2020 10:05 a.m. (1) 60-inch mower and two (2) 72-inch Cooperative from Berend Turf & Tractor, LP Ordinance appropriating $4,552,789 in Federal Coronavirus Aid, Relief, and Economic Security (CARES) Act Funds for Texas Section 5307 Operators and authorizing the City Manager to execute all necessary funding agreements related hereto Mayor Santellana opened the public hearing at 8:36 a.m. Moved by Councilor Chenault to approve Ordinance 22-2020. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley CITY COUNCIL MINUTES April 21, 2020 Page 2 Nays: None Item 6b — Ordinance 23-2020 10:09 a.m. Ordinance authorizing the City Manager to execute all documents necessary to apply for and accept $600,000 in Texas Department of Transportation Aviation Division Non - Primary Entitlement grants for hangar construction at Kickapoo Downtown Airport Moved by Councilor Brewer to approve Ordinance 23-2020. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 6c - Ordinance 24-2020 10:13 a.m. Ordinance making an appropriation to the Special Revenue Fund for Public Health Emergency Preparedness in the amount of $148,094 received from the Department of State Health Services and authorizing the City Manager to execute contract accepting same Moved by Councilor Jackson to approve Ordinance 24-2020. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 6d — Ordinance 25-2020 10:15 a.m. CITY COUNCIL MINUTES April 21, 2020 Page 3 Ordinance continuing and modifying the Shelter in Place Order; declaring an emergency. Moved by Councilor Smith to approve Ordinance 25-2020. Motion seconded by Councilor Brewer. Kinley Hegglund, City Attorney, reviewed the proposed changes. A discussion was held concerning possibly using masks to slow the spread, the effectiveness of cloth masks, and the difficulty finding paper masks to purchase. It was stated that the Center for Disease Control (CDC) highly recommends individuals wear masks when in enclosed public places. Lou Kreidler, Director of Health, agrees with the CDC recommendation and discussed that other cities are requiring citizens to wear masks in public. Ms. Balthrop read comments from the following citizens: Dwight Haywood — expressed his concern that he cannot detail vehicles from car dealerships at his private detail shop. Jordan Peach — expressed his concern with other stores that specialize in tobacco and vaping products being allowed to reopen. Randi Lewis — expressed her concern with hair salons being closed, asked what the plan was moving forward, and discussed social distancing and sanitizing practices that could be used in salons. Lynn Taylor — expressed her concerns about hair salons, nail salons, and massage parlors being closed. Phillip Stephan, MD — stated that the pandemic has not hit Wichita Falls as previously described, urged council to reopen the economy, and stated that Wichita Falls should not be treated the same as larger cities. Olivia Nickman — expressed her concerns about her children's resale shop not being able to be open. Ms. Nickman gave several examples showing why she feels her business is essential. There was discussion about the ability to eat in your car at a restaurant, and possible changes moving forward. There was further discussion about personal responsibility, and how Governor Abbott's order will affect our plans going forward. Ms. Kreidler discussed the Governor's order and how it addressed restaurant take out, and that restaurants would be required to open their restrooms to customers if they are allowed to eat on site in their vehicle. It was discussed that the intent was to keep people from gathering in one area to reduce spread, and our legal responsibility to comply with the Governor's order. CITY COUNCIL MINUTES April 21, 2020 Page 4 Motion carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None Item 6 — Items of Concern to Members of the City Council 11:11 a.m. Ms. Kreidler stated that it has been both a sad and happy week. There were two deaths this week and our thoughts and prayers are with those families during this time. We continue to have single digit cases or no cases over the week, and have six recovered. Councilor Jackson — Stated his concern with small children playing on park equipment without supervision, urged parents to know where their children are and to be responsible parents. The sooner we can get the economy going the better, especially with the oil crisis. He read that the state is going to run out of unemployment money and stated his concerns with those having difficulty receiving benefits. Urged everyone to work together and be responsible. He has received several calls regarding salons and modifications they can make to reopen, and hopes the Governor will reopen things soon. Be responsible adults and watch after your children. Councilor Browning - Stated that personal responsibility is the only way we are going to get out of this. Councilor Whiteley — Reiterated that people need to be responsible, and to bear with us as we do the best we can to help our community get back while taking health and safety precautions. Councilor Chenault — Said good morning and thank you for tuning in. Have a great week. Councilor Smith — Asked that everyone remember our city staff that are providing all of the regular services we are used to and need to receive. This is on top of the stress, anxiety and extra hours being worked. Hats off to these employees for their good work. He would also like to remember our school districts and stated that although they are not in their rooms they are still working and making contact with their students in various ways. We are not going back to normal anytime soon. Councilor Brewer — Thanked Ms. Kreidler for all her and her department does for the city. Several people have asked him if he has seen someone that has had the virus, CITY COUNCIL MINUTES April 21, 2020 Page 5 and he said yes he has as the second person that passed away is someone he went to school with. It is our responsibility to keep the economy going, but it is also our responsibility to keep people alive. He appreciates everyone's comments. Mayor Santellana — Prayers go out to the families of the two individuals that we lost in our community. The oil crisis is very impactful for our community and our hearts and prayers go out to them. In regards to the task force, they are working hard to come to a nice balance of rules to help open our economy. Hoping the Governor comes forth with new direction to assist with these issues. Encourage everyone if they have a little extra to share it with others, if we can all help each other out we will be better off. Keep your head up, these are strange times we are going through but there are a lot of people trying to find solutions to turn things around. Having a virtual meeting was a little different and even though there were a few glitches, it worked well and this is the responsible way to meet while we are under shelter in place. Thank you to the council, staff, legal team, and health department for all you do. Encourage everyone to be responsible. Thank you to everyone for your hard work, and reminded everyone that shelter in place is a living document that we will continue to change as needed. Item 7 — Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda 11:27 a.m. Ms. Balthrop read the following citizen comments received via email: Rebecca Ruddy — Asked if we release the names of the people serving on the task force to reopen the city economy.
