Res 136-2003 10/21/2003RESOLUTION NO. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ESTABLISHING A POLICY FOR THE SALE OF CITY - OWNED PROPERTY TO AN ABUTTING PROPERTY OWNER; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the development of property in the City results in various encroachments upon City rights -of -way and other City -owned property; and WHEREAS, the City may receive a request from the abutting property owner to sell the property or a part of the property to the abutting property owner; and WHEREAS, the City may determine it is in the best interest of the City to sell all or a part of such property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. In the event an abutting property owner's property encroaches upon City -owned right-of-way or other City property, the abutting property owner may ask the City to convey the City's interest in its property to remedy the encroachment. The request shall be made to the City's Property Administrator, who shall process the request for consideration by the City Council. The abutting property owner shall pay in advance for all expenses necessary to process the request, including any survey and appraisal fees. In the event the City Council decides to convey the City's interest in the property, the abutting property owner shall pay the City the greater of One Thousand ($1,000.00) Dollars or the appraised value of the property. The purchase price does not include expenses paid by the requestor to process the request. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 21 St day of October, 2003.
