Min 01/21/2020 City of Wichita Falls City Council Meeting Minutes January 21, 2020 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 with the following members present. Stephen L. Santellana - Mayor DeAndra Chenault - Mayor Pro Tem/Councilor District 2 Tim Brewer - Councilor District 4 Jeff Browning - Councilor District 3 Steve Jackson - Councilor District 5 Michael Smith - Councilor District 1 Bobby Whiteley - Councilor At-Large Darron Leiker - City Manager Kinley Hegglund - City Attorney Marie Balthrop - City Clerk Mayor Santellana called the meeting to order at 8:30 a.m. - - - - - - - - Item 2a Invocation Reverend John McLarty, First United Methodist Church, gave the invocation. - - - - - - - - Item 2b Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. - - - - - - - - Item 3-4 Consent Agenda 8:32 a.m. City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Browning to approve items on the consent agenda. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith and Whiteley. Nays: None Item 3 Approval of minutes of the January 7, 2020 Regular Meeting of the Mayor and City Council Item 4 Receive Minutes (a) Wichita Falls Wichita County Public Health Board, November 8, 2019 (b) Lake Wichita Revitalization Committee, December 10, 2019 - - - - - - - Item 5a Ordinance 03-2020 8:33 a.m. Ordinance authorizing acquisition by purchase and/or condemnation of the property described as 1.91 acres, Block 11, Denton County School Land, LG1 for the Quail Creek Drainage Project: Phase I. Moved by Councilor Brewer to approve Ordinance 03-2020. Motion seconded by Councilor Jackson and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith and Whiteley. Nays: None - - - - - - - Item 5b Ordinance 04-2020 8:35 a.m. Ordinance making an appropriation to the Special Revenue Fund for the Tuberculosis Prevention and Control Program State in the amount of $7,291 received from the CITY COUNCIL MINUTES January 21, 2020 Page 2 Department of State Health Services and authorizing the City Manager to execute contract accepting same. Moved by Councilor Chenault to approve Ordinance 04-2020. Nays: None - - - - - - - Item 5c Ordinance 05-2020 8:37 a.m. Ordinance making an appropriation to the Special Revenue Fund in the amount of $13,000.00 for grant funding from the Dallas Internet Crimes Against Children Task Force, which is administered by the City of Dallas Reimbursement Program. Moved by Councilor Brewer to approve Ordinance 05-2020. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith and Whiteley. Nays: None - - - - - - - Item 6a Resolution 05-2020 8:38 a.m. Public Hearing. Mayor Santellana opened the public hearing at 8:38 a.m. Kinley Hegglund, City Attorney, stated that every two years the City Council is required to adopt guidelines and criteria in order to continue the tax abatement program. The city has adopted the same guidelines and criteria for the past decade and there are no changes with this adoption. There were no public comments. Mayor Santellana closed the public hearing 8:40 a.m. CITY COUNCIL MINUTES January 21, 2020 Page 3 Texas Tax Abatement Program to promote development and redevelopment and adopt guidelines and criteria for tax abatement in the City of Wichita Falls. Moved by Councilor Brewer to approve Resolution 05-2020. Motion seconded by Councilor Chenault and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None - - - - - - - Item 6b Resolution 06-2020 8:41 a.m. Resolution Authorizing the City Manager to Execute an Agreement with AETC Housing L.P. (Balfour Beatty) to Provide Municipal Services at Sheppard Air Force Base Housing Communities. Moved by Councilor Chenault to approve Resolution 06-2020. Motion seconded by Councilor Browning. Paul Menzies, Assistant City Manager, discussed the purpose of the agreement which is to continue to provide city services such as fire, police, sanitation, etc. to base housing. The city receives approximately $600,000 in revenue from this agreement, and the agreement is for five years. There was discussion about fire and police response times and how Sheppard Air Force Base Fire Department handles calls on the base. Response times vary based on the type of call received. T.P. Hillman, 3616 Alexandria, addressed the council and provided printed material to each councilor. Mr. Hillman read a prepared statement that discussed his view of issues with base housing, and Balfour Beatty. Mr. Hillman suggested amending the agreement to a one year agreement instead of five. It was clarified that the Department of Defense has a contract with Balfour Beatty for CITY COUNCIL MINUTES January 21, 2020 Page 4 although Mr. Hillman discussed valid issues, they are not issues that concern our contract. Not renewing this contract would only penalize the tenants of these properties. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None - - - - - - - Item 6c Resolution 07-2020 8:56 a.m. Resolution authorizing City staff to submit a letter to the Texas Parks and Wildlife at Lake Wichita. Moved by Councilor Brewer to approve Resolution 07-2020. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None - - - - - - - Item 6d Resolution 08-2020 9:01 a.m. Resolution authorizing the purchase and installation of 9 AIRVAC 911 Exhaust Removal units and all other related accessories for Fire Station 1 and 2 in the amount of $61,517 from Air Vacuum Corporation of Dover, New Hampshire. Moved by Councilor Browning to approve Resolution 08-2020. Moved by Councilor Brewer to approve Resolution 09-2020. Motion seconded by Councilor Browning and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None - - - - - - - Item 6f Resolution 10-2020 9:11 a.m. th Resolution allowing the trustee property located at 1908 6 Street to be sold to Base Camp Lindsey for $5,000 which is less than the total amount of the judgment against said property as authorized by Section 34.05(i) of the Texas Tax Code and authorizing execution of the Quitclaim deed to convey title to Base Camp Lindsey. Moved by Councilor Brewer to approve Resolution 10-2020. Motion seconded by Councilor Jackson. Discussion was held concerning the history of the property and how Base Camp Lindsey plans to utilize this property. The goal is to take veterans from homelessness to independence, and once they have ownership of the property they can apply for grant funds. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None - - - - - - - CITY COUNCIL MINUTES January 21, 2020 Page 6 Item 6g Resolution 11-2020 9:20 a.m. Resolution authorizing the City Manager to execute an Advertising Services Agreement with Wichita Falls Truck Center, LLC dba Impact Signs at Falls Truck Center, for the purpose of selling advertisement on City Buses. Moved by Councilor Brewer to approve Resolution 11-2020. Motion seconded by Councilor Chenault and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None - - - - - - - Item 6h Resolution 12-2020 9:22 a.m. Resolution authorizing a guaranteed maximum price of $2,923,805 in the Construction Manager at Risk contract with Anthony Inman Construction, Inc. for Package #1 Work associated with construction of the Public Transportation Repair and Maintenance Facility Project. Moved by Councilor Brewer to approve Resolution 12-2020. Motion seconded by Councilor Chenault and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, Smith, and Whiteley Nays: None - - - - - - - Item 7 Items of Concern to Members of the City Council 9:27 a.m. Councilor Jackson thanked Steve Holloway for his work with Base Camp Lindsey, and he hopes some of Mr. today. CITY COUNCIL MINUTES January 21, 2020 Page 7 Councilor Brewer thanked Pat Hoffman for all the information she provides and her hard work. Councilor Chenault said good morning and thanked everyone for coming out. Thank you to Mr. Wilkinson from Transportation for signs placed in front of Mt. Pleasant Baptist Church after an elderly member almost got run over this past week. Councilor Whiteley thanked Chief Prillaman and the Fire Association for those that attended the funeral in Lubbock for a line of duty death. Wichita Falls was well represented. Councilor Smith discussed the upcoming Census and stated that everyone counts, and April 1 is census day. The Census is about fair representation, is a constitutional requirement every ten years, affects federal funding, and affects redistricting. Taking part in the census is your civic duty and there are various ways to respond. Last summer there was a Ride to Read program where young people and parents could ride the city bus to the library and he would like to continue this again this summer and possibly year round. Mayor Santellana discussed the importance of the census and getting a complete and accurate count, especially in undercounted areas. He asked that as a community we help ensure our families, friends and neighbors are counted. - - - - - - - Item 8 Comments from the Public to Members of the City Council Concerning Items that are not on the City Council Agenda 9:32 a.m. Tomas Narvais, Jr., 1669 Keeler, addressed the council in reference to a mound of dirt in the right-of-way between the curb and walk that needs to be removed. He has tripped on this mound and it is hard to mow.
