CALL TO ORDER The meeting was called to order by Vice Chairman Wachsman at 2:00 p.m. Councilor Burns swore in James Bradberry® the newly appointed alternate. II. PUBLIC COMMENTS No one from the audience wished to address the Commission. III. APPROVAL OF MINUTES PLANNING1COMMISSION MAY 10, 2000 • PAGE 1 Mr. Berg made a motion to approve the minutes of the April meeting. Mr. on seconded the motion. The minutes were passed with a unanimous vote in favor. IV. CONSENT AGENDA 1. Public Hearing on Preliminary Plats — none received 2. Public Hearing on Final Plats The Planning & Zoning commission recommended approval of the following plats subject to the Standard Conditions of Approval for Final Plats and Replats and any specific conditions listed below: Recommend approval subject to standard conditions and any specific conditions listed below: • Provide utility easements as required by utility companies and Director of Public Utilities and drainage easements as required by Director of Public Works. • Submit water and sewer plans to Utilities Engineer; water plans to the Fire Marshall; and street, sidewalk and drainage plans to the Director of Public Works. Drainage plans must be complete enough to include impact on surrounding property and include detention facilities as required by Director of Public Works. • Coordinate street lighting plan with Director of Traffic and Transportation, if underground electric utilities are to be provided. V. REGULAR AGENDA 1. Rezone from SF-2 to GC 1218 37th Street Case R 00-05 Case No.: R 00-05 Applicant: Mary Stengel Requested action: Rezoning Purpose: Rezone from SF-2 to GC Property: 121837 th Street, Lot 25, Block 19, Hillcrest Addition Existing Land Use: Residence Surrounding land Use and Zoning: N: Residential, SF-2 S: Midwestern Parkway, Auto Repair, GC PLANNING & ZONING COMMISSION MAY 10, 2000 • PAGE 3 ••• 1 :. Analysis: The Food Bank has requested a zoning change from Single Familyresidential to General for this property at 1218 37th Street. In 1996 the Food Bank rezoned the lot to the west of this tract to allow additional space for a planned expansion. This rezoning would extend this General Commercial district for one additional lot. . Changed conditions: Staff analyzed the rezoning to identify conditions that have changed in the district or may have changed outside the district that directly or indirectly affect land use adjacency. The land uses in this neighborhood have not changed significantly since the 1996 rezoning. b. Relationship o the ComprehensivePlan: Staff considered the effects of the land uses allowed under that proposed zoning district relative to conformance with the i Comprehensive Plan. The Plan currently designates this tract Low Density Residential. The change to General Commercial zoning will require an amendment to the Land Use Plan. The classification of this lot should be amended from Low Density Residential to Commercial. c. This rezoning will allow the Food Bank to expand and give deliveryvehicles more room to maneuver, This may lessen any traffic congestion associated with this operation. The rezoning does not include an approval of a particular site plan or development. When plans for this lot are received, staff will evaluate parking, truck movements, etc. to reduce possible adverse impacts. If this rezoning is approved, staff will include an amendment to the Land Use Plan with the rezoning ordinance. The amendment will change this property classification from Low Density Residential to Commercial. McDowell Survey, Abstract 194 Vacant N: Vacant, GC S: Vacant, Outside of City Limits E: Crestview Cemetery, GC W: Agricultural Land, SF-1 Anaiysis: The property owners are requesting a rezoning of an 11.2-acre tract from Single Family- 1 to Multifamily Residential zoning. This property is located at the corner of Rathgeber Road and Crestview Memorial Drive. Of this tract, 2.3 acres are within the city limits and are zoned Single Family-1, the remaining 8.91 acres are outside the city and are not zoned. Developers are proposing a low-income elderly housing complex for this tract. Since the 8.91 acre site is outside of the City, this property can be rezoned by the City Council only after annexation. The property owners have already begun the petitioned annexation process for this tract. Staff therefore will delay presenting this item before the City Council until annexation has occurred. d. Changed conditions: Staff analyzed the rezoning to identify conditions that have changed in the district or may have changed outside the district that directly or indirectly affect land use adjacency. The land east of here, the Arbor Hills Subdivision, 39.42 acres, was annexed at the request of the property owner for manufactured homes in May 1998. The 2.3 acre part of this tract (being a 200-foot strip along Rathgeber Road) has been in the city longer; it was annexed in 1979. e. Relationship to the Comprehensive Plan: Staff considered the effects of the land uses allowed under that proposed zoning district relative to conformance with the City's Comprehensive Plan. The Plan currently designates all of this land for Low - Density Residential use. The change to High Density Residential will require an amendment to the Land Use Plan. There are several multifamily developments to the north of here, along Professional Drive. If this rezoning is approved, an amendment to the Land Use Plan is also required. The amendment would change this property classification from Low Density Residential to High Density Residential. Recommendation: Staff recommends approval of this rezoning. 3. Jackson Conditional Use Permit Manufactured Home 4910 Old Windthorst Road, Newby Subdivision Vacant Lot N: Residence, SF-1 S: Residence, SF-1 E: Vacant, SF-1 W: Vacant, SF-1 Analysis: The property is located on the west side of Old Windthorst Road. Teapplicant requests Conditional Use Permit approval for a manufactured home on this single family zoned lot. The manufactured home measures 28' x 76' (1944 sqw ft), contianing 3- bedrooms and two bathrooms. The surrounding area consists of large lots with single family homes. Some structures in the area are homes moved in from other locations. The Staff feels that a manufactured home is compatible with the surrounding neighborhood recommends approval of this request. Communications Tower 3302 Seymour Highway Case C 00-19 Case No.: C 00-19 Applicant: Mesa Communication Group, LL Requested action: Conditional Use Permit Purpose: Communications Tower Property:3302 Seymour Highway, Brookfield Industrial Center Addition, Block 1, Lots 1 and Existing Land Use: American Medical Response, Rays Garage, Natural Gas Pipeline Facility, GC Surrounding Land Use & Zoning: N: Vacant, Wichita River, GC Office, Residence, Church, KAUZ TV, GC %r,,, E:Mini-warehouses, GC W: TXU Substation, GC Analysis: This site is located on the north side of Seymour Highway about one-half mile west of the Loop 11 intersection. The applicant is requesting a Conditional Use Permit for a 1099-foot communication tower. Communication towers require a conditional use permit in a General Commercial zone. Because of the height of the tower, three guy anchors will support the tower. The anchors extend about 600 feet from the tower. About 1000 feet to the south is the 1028 feet tall KAUZ TV tower, The KAUZ tower has a height of 2046 feet above sea level, while the proposed tower will be 2049 feet above sea level. The applicants have submitted an aeronautical study (attached) that approves this structure. The report notes that, "Therefore, it is determined that the proposed construction would not have a substantial adverse effect on the safe and efficient utilization of the navigable air space by aircraft or on any air navigation facility and would not be a hazard to air navigation." The report also notes that the tower will be located in proximity to existing structures of comparable heights. Approval of the Conditional Use Permit includes the following condition: This approval only pertains to the proposed tower as described herein.
