Min 11/05/2019 City of Wichita Falls City Council Meeting Minutes November 5, 2019 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above with the following members present. Stephen L. Santellana - Mayor DeAndra Chenault - Mayor Pro Tem Tim Brewer - Councilors Jeff Browning - Steve Jackson - Eric West - Bobby Whiteley - Darron Leiker - City Manager Kinley Hegglund - City Attorney Marie Balthrop - City Clerk - - - - - - - - Mayor Santellana called the meeting to order at 8:30 a.m. - - - - - - - - Item 2a Invocation Reverend David Sapata, DAV TX Chapter 41, gave the invocation. - - - - - - - - Item 2b Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. - - - - - - - - Item 3a Employee of the Month Betty Wiseman, Property Management 8:32 a.m. Pat Hoffman, Property Management/Lake Lot Administrator, recognized Betty Wiseman as the Employee of the Month for November 2019. Mayor Santellana congratulated Ms. Wiseman and presented her with a plaque, letter of appreciation, restaurant voucher, and check, and thanked her for her service. - - - - - - - - Item 4-6 Consent Items 8:37 a.m. City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None Item 4 Approval of minutes of the October 15, 2019 Regular Meeting of the Mayor and City Council Item 5a Resolution 112-2019 Resolution designating Jessica Williams as Authorized Official for Grant/App 3790201 with the State Homeland Security Grant Program via the Office of the Governor for National Incident Management (NIMS). Item 5b Resolution 113-2019 Resolution authorizing the purchase of one (1) turnkey sewer jetter truck through the BuyBoard Purchasing Cooperative from Texas Kenworth Company dba MHC Kenworth Dallas in the amount of $240,085.72. Item 5c Resolution 114-2019 CITY COUNCIL MINUTES November 5, 2019 Page 2 Resolution authorizing the purchase of one (1) Tymco Model 600 Regenerative Air Sweeper through the Houston-Galveston Area Cooperative (H-GAC) from Tymco, Inc., in the amount of $249,945.00. Moved by Councilor Chenault to approve Ordinance 52-2019. Motion seconded by Councilor Browning. Lou Kreidler, Director of Health, reviewed the process and timeline leading up to the amendment of Chapter 14 Animals, and provided an overview of the major changes. Both the Animal Shelter Advisory Committee and the Board of Health voted unanimously to approve the ordinance. Larry Robinson, 5559 Huntington Lane, addressed the council and discussed section14-452 regarding shelter for livestock, and requested clarification on these rules. Ms. Kreidler stated that under the livestock production section of the ordinance shelter is required. Almost all of the twenty ordinances reviewed included shelter requirements for livestock. Leslie Harrelson, 3800 Arena Road, thanked the Mayor and City Council, Lou Kreidler, Amy Fagan and the Animal Services staff for the time that has been spent on the revision of this ordinance. Ms. Harrelson discussed animal welfare in the city and moving toward a pet friendly community. Ms. Harrelson asked that the council please vote in favor of this Ordinance. CITY COUNCIL MINUTES November 5, 2019 Page 3 Eric West discussed a late email he received from a citizen in reference to the ability to breed an animal more than three times, as the citizen did not see a medical reason for this. Ms. Kreidler stated that the research they completed showed that three whelpings for a female dog was suggested. Councilor West stated the citizen also asked about distance requirements for kennels and Ms. Kreidler stated that those requirements are for commercial kennels to address noise and odor issues. Mayor Santellana discussed a concern from a landowner on Huntington Lane and 287 in reference to hunting on land within city limits. Mayor Santellana discussed the flexibility, research, and public input that have been put into this ordinance revision. He appreciates the emails and public comment that brought up points we may not have thought of. There were 29 revisions to this proposed ordinance. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, West, and Whiteley Nays: Councilor Jackson - - - - - - - Item 7b Ordinance 53-2019 8:53 a.m. Ordinance amending Chapter 106, Utilities, of the Code of Ordinances of the City of Wichita Falls, at Division 4, Rates and Charges, Section 106-128, Credit card payments; convenience fees, to establish a service fee in lieu of a convenience fee when paying a utility bill by credit card. Moved by Councilor Chenault to approve Ordinance 53-2019. Motion seconded by Councilor Browning and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, West, and Whiteley Nays: Councilor Jackson - - - - - - - Item 7c Ordinance 54-2019 9:08 a.m. CITY COUNCIL MINUTES November 5, 2019 Page 4 Ordinance replacing Ordinance No. 45-2019, the fee schedule applied to City operations; providing for severability; providing that such ordinance shall not be codified; and providing an effective date. Moved by Councilor Chenault to approve Ordinance 54-2019. Moved by Councilor Brewer to approve Ordinance 55-2019. Moved by Councilor Chenault to approve Ordinance 57-2019. Motion seconded by Councilor Jackson and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 7g Ordinance 58-2019 9:23 a.m. Proposal to rezone +/- 0.36 acres of land located at 3100 Avenue S (Lot 18, Block 5, West Side Addition) and abutting right-of-way from Single Family 2 (SF-2) to General Commercial (GC) to allow the property to be used as outdoor storage; and amending the Land Use Plan to change the area from Low Density Residential to Commercial. Mayor Santellana opened the public hearing at 9:24 a.m. Terry Floyd, Director of Development Services, addressed the Council and discussed the timeline, and events leading up to the rezone of this property. Planning and Zoning has approved the zoning and land use change and staff recommends approval. Councilor Whiteley stated that this is a success story of a business expanding that has been open for over a decade. He wants to make sure that we all know how well the staff worked with the owner to make this happen, as he received multiple compliments. Mayor Santellana closed the public hearing at 9:28. Rosewood Ave., and 601 Denver St., to be sold for less than the total amount of the judgement against said properties as authorized by Section 34.05(i) of the Texas Tax Code and authorizing execution of the deeds to convey title to Eric Dibble (809 N. Rosewood Ave.) and Keith Williams (601 Denver St.) Moved by Councilor Chenault to approve Resolution 115-2019. Moved by Councilor Chenault to approve Resolution 120-2019. Moved by Councilor Brewer to approve Resolution 121-2019. Councilor West is stepping off the City Council due to a job change that will be taking more of his time. Mayor Santellana discussed the amount of time and effort Councilor West has given to the City, and stated that he admires him for making the decision to give his time to his new job and family. Councilor West applies his Christian values to every decision he makes and always does the right thing. The Council and Staff thank Councilor West for his dedication and service. Councilor West expressed his gratitude to his family and specifically his wife for being here today and for her support. Thank you to Sheppard Air Force Base for their support, and the City Staff for always answering his questions. Thank you to the residents of District 1 and the City for being involved and asking the questions, and he appreciates citizens for stepping up and asking questions, even the hard ones. Councilor West thanked the Council and especially Mayor Santellana stating he is a great leader that has his respect and gratitude. Councilor Brewer stated that he enjoyed the air show at Sheppard Air Force Base and there were thousands in attendance. Councilor Chenault said good morning and thank you for coming out. This weekend the was held and she wanted to give a shout out to Harry Patterson and Patterson Auto for sending vehicles for the parade. Go CoyotesNovember 23, 2019. Councilor Whiteley stated that the Action Delegation Meeting will be held for the construction industry and he would like to reach out to professionals in this field to send in applications. Congratulations to Betty Wiseman for employee of the month. Councilor Whiteley thanked Terry Floyd and his staff and stated that it is a big deal when they receive phone calls giving compliments. Thank you to Eric West for his service on council, it has been a pleasure sitting beside you. Councilor Jackson thanked Councilor West for his service and stated that he feels Councilor West is a great asset to this community. Councilor Jackson stated he serves on a committee to assist Base Camp Lindsay and there is an event this Saturday to assist with funding. He hopes the City Council can donate the Denver Street facility as CITY COUNCIL MINUTES November 5, 2019 Page 10 this will assist veterans in our community. There are seventy to eighty veterans on the street in Wichita Falls every night.
