Ord 59-2019 Canvassing Returns 2019 Special Election 11/12/2019 ORDINANCE NO. 59-2019 ORDINANCE BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF THE VENUE PROJECT ELECTION; AND CONTAINING PROVISIONS NECESSARY AND INCIDENTAL THERETO WHEREAS, the City Council duly authorized an election to be held within the City of Wichita Falls, Texas the City the propositions hereinafter set forth; WHEREAS, this City Council has investigated all matters pertaining to said Election; and WHEREAS, the Election officers who held said Election have duly made the return of the results thereof, and said returns have been duly delivered to this City Council; WHEREAS, the City Council finds and declares that the meeting at which this Ordinance is considered is open to the public as required by law, and that the public notice of the time, place and purpose of the meeting was given as required by Texas Government Code, Section 551.041, as amended; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: Section 1. It is officially found and determined that said Election was duly ordered, that proper notice thereof was duly given, that proper Election officers were duly appointed prior to said Election, that said Election was duly and lawfully held, that due returns of the result of said Election have been made and delivered, and that this City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said Election. Section 2. It is officially found and determined that the following votes were cast at said Election on the submitted propositions by the resident qualified electors of the City who voted at said Election: CITY OF WICHITA FALLS, TEXAS SPECIAL ELECTION CITY OF WICHITA FALLS, TEXAS PROPOSITION A FOR 4103 AUTHORIZING THE CITY OF WICHITA FALLS, TEXAS TO RENOVATE, MAINTAIN AND IMPROVE THE EXISTING MULTI-PURPOSE EVENTS AGAINST 1874 CENTER CONSISTING OF THE RAY CLYMER EXHIBIT HALL, THE KAY YEAGER COLISEUM AND THE J.S. BRIDWELL AGRICULTURAL CENTER AS A VENUE PROJECT AND TO IMPOSE A NEW HOTEL OCCUPANCY TAX AT THE RATE OF TWO PERCENT (2%) FOR THE PURPOSE OF FINANCING THE VENUE PROJECT. IF APPROVED, THE MAXIMUM HOTEL OCCUPANCY TAX RATE IMPOSED FROM ALL SOURCES IN THE CITY OF WICHITA FALLS WOULD BE FIFTEEN PERCENT (15%) OF THE PRICE PAID FOR A ROOM IN A HOTEL. CITY OF WICHITA FALLS, TEXAS SPECIAL ELECTION CITY OF WICHITA FALLS, TEXAS PROPOSITION B FOR 4313 AUTHORIZING THE CITY OF WICHITA FALLS, TEXAS TO RENOVATE, MAINTAIN AND IMPROVE THE EXISTING PERFORMANCE HALL IN AGAINST 1639 MEMORIAL AUDITORIUM AS A VENUE PROJECT AND TO IMPOSE A NEW HOTEL OCCUPANCY TAX AT THE RATE OF TWO PERCENT (2%) FOR THE PURPOSE OF FINANCING THE VENUE PROJECT. IF APPROVED, THE MAXIMUM HOTEL OCCUPANCY TAX RATE IMPOSED FROM ALL SOURCES IN THE CITY OF WICHITA FALLS WOULD BE FIFTEEN PERCENT (15%) OF THE PRICE PAID FOR A ROOM IN A HOTEL. Section 3. As a result of said Election, and in conformity with law, this City Council is authorized to take all necessary action on behalf of the City for the propositions which favorably passed and in the manner and to the extent set forth in the proceedings calling said Election, and as and to the extent authorized by said Election and that the hotel occupancy tax may be levied, collected and applied for the lawfully voted purposes. Section 4. This Ordinance shall be in full force and effect from and after its passage and it is accordingly so resolved.
