Res 099-2019 Bingo Prize Fees HB 914 10/1/2019Resolution authorizing the City of Wichita Falls to continue
collection of bingo prize fees in accordance with House Bill (HB) 914,
enacted by the 86t" Texas Legislature
WHEREAS, non-profit charitable organizations conducting bingo collect a 5% fee
on prizes awarded; and,
WHEREAS, these funds are submitted each quarter to the Texas Lottery
Commission, which in turn remits a pro rata share of the funds to local governments at
the end of each fiscal year; and,
WHEREAS, prior to September 1, 1993, the City of Wichita Falls elected to
receive a share of bingo prize fees collected in the City; and,
WHEREAS, pursuant to House Bill 914 enacted by the 86t" Texas Legislature, in
order to continue to receive a share of bingo prize fees after January 1, 2020, the City
Council must affirmatively vote to do so, and submit proof of that vote to the Texas
Lottery Commission by November 1, 2019; and,
WHEREAS, the City Council has determined that it is in the best interests of the
City of Wichita Falls to continue to receive a share of such bingo prize fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The City Council hereby:
(1) approves of the continued receipt of the share of bingo prize fee funds
(2) directs City staff to notify the Texas Lottery Commission of such decision no
later than November 1, 2019.
(3) The Council further directs staff to notify each licensed authorized
organization within the county's or municipality's jurisdiction, as applicable,
of the continued imposition of the fee.
