ORDINANCE CALLING A SPECIAL ELECTION BY THE QUALIFIED VOTERS OF THE
CITY OF WICHITA FALLS, TEXAS ON NOVEMBER 5, 2019 ON THE QUESTIONS OF
DESIGNATING THE RENOVATION, MAINTENANCE AND IMPROVEMENT OF THE
MULTI-PURPOSE EVENT CENTER AND THE PERFORMANCE HALL IN MEMORIAL
AUDITORIUM AS VENUE PROJECTS, APPROVING AN INCREASE IN THE HOTEL
OCCUPANCY TAX IN THE CITY AND DESIGNATING METHODS OF FINANCING FOR THE
VENUE PROJECTS IN ACCORDANCE WITH CHAPTER 334, TEXAS LOCAL
GOVERNMENT CODE,AS AMENDED;MAKING PROVISION FOR THE CONDUCT OF THE
ELECTION; AND CONTAINING OTHER PROVISIONS INCIDENT AND RELATED TO THE
PURPOSE OF THIS ORDINANCE
WHEREAS,in the Resolution adopted by the City Council of the City of Wichita Falls,Texas(the
"City") on June 4, 2019 (the "Venue Designation Resolution"), the City designated the existing Multi-
Purpose Event Center consisting of the Ray Clymer Exhibit Hall, the Kay Yeager Coliseum and the J.S.
Bridwell Agricultural Center,and in particular the City's renovation,maintenance and improvement of the
Multi-Purpose Events Center, a "venue project" (referred to herein as the "MPEC Venue Project") and
declared its intention to finance and to provide for the undertaking of the MPEC Venue Project,all pursuant
to the authority granted by Chapter 334,Texas Local Government Code (the "Act"); and
WHEREAS, in the Venue Designation Resolution the City also designated the existing
Performance Hall in Memorial Auditorium, and in particular the City's renovation, maintenance and
improvement of the Performance Hall in Memorial Auditorium,a"venue project"(referred to herein as the
"Auditorium Venue Project"and collectively with the MPEC Venue Project,as the "Venue Projects") and
declared its intention to finance and to provide for the undertaking of the Auditorium Venue Project, all
pursuant to the authority granted by the Act; and
WHEREAS,the City has received a determination from the Comptroller of Public Accounts that
the Venue Projects will not have a significant negative fiscal impact on state revenue, as required by the
Act; and
WHEREAS,pursuant to the Act,the City Council deems it advisable to call a special election(the
"Election") on the questions of authorizing the Venue Projects and authorizing an additional hotel
occupancy tax at a rate not to exceed two percent(2%)as and to the extent authorized by Subchapter H of
the Act; and
WHEREAS, it is hereby officially found and determined that holding the Election on the date set
forth below is in the public interest; and that the meeting was open to the public, and public notice of the
time,place and purpose of the meeting was given,all as required by Chapter 551,Texas Government Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS,TEXAS:
Section 1. Findings.The findings set out in the preamble to this ordinance are hereby in all things
approved and adopted.
Section 2. Election Date: PollingP . The Election shall be held in the City of Wichita Falls,
Texas,between the hours of 7:00 a.m. and 7:00 p.m. on November 5,2019("Election Day"). Election Day
voting is to be administered by the Wichita County Clerk, as provided in the Texas Election Code (the
"Code"). Voting on Election Day shall occur during the hours and at the designated polling places
designated as set forth in Exhibit"A"attached hereto,which exhibit shall be modified to include additional
or different Election Day polling places required to conform to the Code.
Section 3. Early Voting. (a)Early Voting is to be administered by the Wichita County Clerk as set
forth in the Code. Early voting shall be conducted by personal appearance at the locations and during the
period early voting is required or permitted by law,being October 21,2019 through November 1,2019,on
the dates and at the times as set forth in Exhibit `B" attached hereto, which exhibit shall be modified to
include additional or different early voting polling places,dates and times required to conform to the Code.
(b) Applications for early voting by mail must be received(not postmarked)by October 25,2019
at the following address: County Clerk,Early Voting Clerk,900 7'Street,Room 250,Wichita Falls,Texas
76301; email: Lori.Bohannon(&co.wichita.tx.us.
If application to vote by mail is made by personal delivery,the application must be delivered by the close
of business on October 18,2019.
Section 4. Propositions. At the Election, the following PROPOSITIONS shall be submitted in
accordance with law:

Authorizing the City of Wichita Falls, Texas to renovate, maintain, and improve the
existing Multi-Purpose Events Center consisting of the Ray Clymer Exhibit Hall,the Kay
Yeager Coliseum and the J.S. Bridwell Agricultural Center(the "MPEC Venue Project")
as a venue project of the type described and defined in, and authorized by, Chapter 334,
Texas Local Government Code, and to approve a two percent (2%) increase in the hotel
occupancy tax imposed by the City as authorized by Section 334.254(a), Texas Local
Government Code, to provide a payment source for revenue bonds or other obligations
issued by the City to finance the MPEC Venue Project.

Authorizing the City of Wichita Falls, Texas to renovate, maintain, and improve the

Section 5. Official Ballots. The official ballots for the Election shall be prepared in accordance
with the Texas Election Code and Chapter 334,Texas Local Government Code,so as to permit the electors
to vote "FOR" or "AGAINST" the aforesaid propositions which shall be set forth in substantially the

Section 6. Persons Qualified to Vote. All resident qualified electors of the City shall be permitted
to vote in the Election.
Section 7.Notice and Conduct of Election. Proper notice of the Election shall be given and,in all
respects, the Election shall be conducted in accordance with the Code and the Home Rule Charter of the
City.
Section 8. Election Officers. That the Wichita County Clerk, early ballot board, voting judges,
voting clerks and all other election officers and officials designated or to be designated pursuant to law are
hereby appointed and confirmed to hold the Election at said polling places and all early voting places.The
Wichita County Clerk and the City may employ other personnel necessary for the proper administration of
the Election,including such part-time help as is necessary for the Election, to ensure the timely delivery of
supplies during early voting and on Election Day.
Section 9. Further Procedures. The City Council hereby authorizes and directs the Mayor, City
Manager, Assistant City Manager, City Clerk, City Attorney and all other officers, employees and agents
of the City, to do and perform all such acts and to execute, acknowledge and deliver in the name and on
behalf of the City, such documents, election contracts, agreements, certificates and other instruments,
whether or not mentioned in this Ordinance,as may be necessary or desirable in order to carry out the terms,
provisions and actions provided for in this Ordinance.
Section 11.Effective Date.This Ordinance shall be in full force and effect from and after its passage
and it is accordingly so ordered.

his 7:00 a.m.y las 7:00 p.m.,el 5 de noviembre de 2019("Dia de las Elecciones").La Votaci6n et Dia de his Elecciones
sera administrada por el Secretario del Condado de Wichita,como se establece en el C6digo Electoral de Texas(el

Center(el"Proyecto de Espacio del MPEC")como on proyecto de espacio para eventus del tipo descrito,definido y
autorzado segon el Capitulo 334 del C6digo de Gobierno Local de Texas,y se aprueba no incremento del dos por
ciento(21/6)an el impuesto de ocupaci6n hotelere gravado por la Ciudad,come,se autoriza en Is Section 334.254(a)
del C6digo de Gobierno Local de Texas,para proveer una Puente de pago para los burns de ingresos u otras
obligaciones emilidas por la Ciudad a fin de financiar el Proyecto de Espacio del MPEC.

Publication Cost: $1,612.00 incremento del dos por ciento(2%)en el impuesto de ocupaci6n hotelera gravado por Is Ciudad,como se autoriza
