Min 06/18/2019 City of Wichita Falls City Council Meeting Minutes June 18, 2019 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above with the following members present. Stephen L. Santellana - Mayor DeAndra Chenault - Mayor Pro Tem Tim Brewer - Councilors Jeff Browning - Steve Jackson - Bobby Whiteley - Councilor At-Large Darron Leiker - City Manager Kinley Hegglund - City Attorney Marie Balthrop - City Clerk Absent: Eric West - District 1 - - - - - - - - Mayor Santellana called the meeting to order at 8:30 a.m. - - - - - - - - Item 2a Invocation Keith Daugherty, Pastor, First Assembly of God, gave the invocation. - - - - - - - - Item 2b Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. - - - - - - - - Item 3-4 Consent Items 8:32 a.m. City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Browning to approve items on the consent agenda. Motion seconded by Councilor Brewer and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None Item 3 Approval of minutes of the June 4, 2019 Regular Meeting of the Mayor and City Council Item 4a Resolution 55-2019 automotive lubricating oils and grease to Western Marketing, Inc., in the amount of $136,007.10. Item 4b Resolution 56-2019 Resolution authorizing a contract for the purchase, installation and maintenance of Turnout Gear Extractor Washer Systems to Gear Cleaning Solutions, LLC. in the amount of $77,389.39. - - - - - - - Item 5a Ordinance 21-2019 8:33 a.m. Ordinance making an appropriation to the Special Revenue Fund for Public Health Emergency Preparedness in the amount of $60,000 received from the Department of State Health Services and authorizing the City Manager to execute contract accepting same. Moved by Councilor Brewer to approve Ordinance 21-2019. Motion seconded by Councilor Chenault and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley City Council Minutes June 18, 2019 2 Nays: None - - - - - - - Item 5b Ordinance 22-2019 8:35 a.m. Ordinance amending the 18/19 Water Utilities Budget and authorizing the City Manager to execute a professional services agreement with Freese and Nichols, Inc. for the design of the Lake Kickapoo Dam Rehabilitation in the amount of $240,300. Moved by Councilor Chenault to approve Ordinance 22-2019. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None - - - - - - - Item 5c Ordinance 23-2019 8:38 a.m. Ordinance amending Article VII Bicycles, of the Code of Ordinances, at Section 102- 256, Riding on roadways and bicycle paths. Moved by Councilor Browning to approve Ordinance 23-2019. Motion seconded by Councilor Jackson. Councilor Jackson asked if this includes Old Iowa Park Road and John Burrus, Director of Aviation, Traffic, and Transportation, stated that they are working with TxDOT, and yes he believes it is included along with Missile Road and City View Drive. David Coleman, 1634 Victory Ave, addressed the council and complemented John Burrus and his staff on their excellent job bringing these ordinances forward. The Bicycle Action Committee is in full support of these items, as they improve safety for cyclist in the city, and support the Bicycle Friendly Community Application. Mr. Coleman appreciates the support of council for this item and the next item as well. Deborah Bacashihua, 4745 Willow Bend Dr., asked what restrictions will be implemented and enforced on the public and how will this affect the Hotter Hell Hundred event. John Burrus stated that if there is a marked bike path we will encourage cyclists to use them. There will be a public information campaign for this ordinance as well as the Vulnerable Road User ordinance. This will not impact the City Council Minutes June 18, 2019 3 Hotter Hell event as those paths are marked off for the event, and we have good communication with the media and police presence during the event. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None - - - - - - - Item 5d Ordinance 24-2019 8:44 a.m. Ordinance amending Chapter 102, Traffic and Vehicles of the Code of Ordinances by the addition of Article VIII, Operation of Vehicles Near Vulnerable Road Users; providing a penalty; providing a repealer clause; providing for inclusion; providing for severability; and providing an effective date. Moved by Councilor Chenault to approve Ordinance 24-2019. Motion seconded by Councilor Browning. Councilor Whiteley asked if both of these ordinances are geared towards the bicycle friendly community certification or just to complement the application, and John Burrus stated that these ordinances will complement the application. Mr. Burrus stated that regardless of the application this is something we should be addressing anyway. Traci Roberts, 2802 Cumberland Avenue, stated that yesterday there was an article in hit last October by a drunk motorcyclist, and spent over two months in the hospital and over six months in rehab learning to walk again. Her son commutes on his bicycle and rides in Hotter Hell every year. She believes these laws are important, should be strictly enforced, and taken seriously. Ms. Roberts stated that her son has had bottles and drinks thrown at him and has had trucks pull up so the passenger could slap him on the head. Ms. Roberts stated that it is ridiculous that cyclists are treated this way in a community that holds one of the largest cycling events in North America. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None - - - - - - - City Council Minutes June 18, 2019 4 Item 5e Ordinance 25-2019 8:51 a.m. Ordinance amending Chapter 102, Traffic and Vehicles of the Code of Ordinances by the addition of Section 102-5, entry upon or jumping on and off or clinging to train or railroad property; providing a penalty; providing a repealer clause; providing for inclusion; providing for severability; and providing an effective date. Moved by Councilor Browning to approve Ordinance 25-2019. Motion seconded by Councilor Jackson. Deborah Bacashihua, 4745 Willow Bend Dr., with the Wichita County Action Network, addressed the council and stated they have been working with the railroad and TxDOT, but one of the problems is there is no fine line jurisdiction in regards to who can cross or stop at this location. It is a very important crossing area with the Salvation Army at that location and no access to banks and grocery stores in that area. There are many people that cross in this area. She is not sure that a fine would be feasible or enforceable with the indigent population in this area and stated that the organization is more concerned with the safety of the citizens in this area rather than imposing a fine. Councilor Chenault expressed concern about the fines since there are many people in this area that cannot afford a fine. Darron Leiker, City Manager, stated that tickets would be discretionary and up to the law enforcement officials. Mr. Leiker stated he would hope that common sense and good judgment would be used with warnings being issued and enforcement being stepped up for repeat offenders, but it is important for us to have an enforcement mechanism for our ordinances. Councilor Jackson stated that he appreciates this being addressed as he has lived off Iowa Park Road most of his life and has witnessed the exact things being talked about. It is a concern and he appreciates it being brought up. Mayor Santellana stated that he agrees with Mr. Leiker that there has to be an enforcement mechanism, and that law enforcement would have discretion. Mayor Santellana said he has witnessed people crossing between and under the cars. He not being able to afford the fine, but he feels that there has to be some mechanism for punishment to stop the behavior. Moved by Councilor Browning to approve Resolution 57-2019. Motion seconded by Councilor Brewer and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None - - - - - - - Item 6b Resolution 58-2019 9:00 a.m. Resolution re-appointing Troy Farris, Ed.D to the Wichita County-City of Wichita Falls Hospital Board. Moved by Councilor Browning to approve Resolution 58-2019. Motion seconded by Councilor Jackson and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None - - - - - - - Item 6c Resolution 59-2019 9:01 a.m. Resolution establishing an advisory Charter Review Committee. Moved by Councilor Brewer to approve Resolution 59-2019. Motion seconded by Councilor Whiteley. There was brief discussion about the committee members, the charge of the committee, and the process after recommendations are made. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley City Council Minutes June 18, 2019 6 Nays: None - - - - - - - Item 7 Items of Concern to Members of the City Council 9:05 a.m. Councilor Jackson - Thanked John Burrus for stepping up and working on the bicycle issue, especially on Iowa Park Road. Thank you to Mr. Schreiber for help with roads in his district. Councilor Chenault - Good morning and thank you for coming out. Councilor Whiteley - Stated that he is glad to see the extractor program going and asked about infrastructure needs to expedite the installation of the equipment. Chief Hughes stated that electrical, plumbing and drain work will need to be completed. Councilor Whiteley stated that this is a big deal as it is a preemptive measure taken to protect the health of our employees. Chief Hughes echoed the importance of preemptive measures. Councilor Whiteley stated he appreciates Chief Hughes work on this. Mayor Santellana - Introduced Mayor for the Day, Trey Inman, son of Anthony and Katie Inman. Trey is a student at Christ Academy, and Mayor Santellana thanked him for being here. - - - - - - - Item 8 Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda. 9:09 a.m. None - - - - - - - Item 9 Executive Session 9:10 a.m. City Council went into Executive Session at 9:10 a.m. in accordance with Texas Government Codes §551.074, and §551.087. City Council reconvened at 10:53 a.m. Mayor Santellana announced that no votes or polls were taken. City Council Minutes June 18, 2019 7 - - - - - - - Item 10 Appointments to Boards and Commissions 10:53 a.m. Wichita Falls Moved by Councilor Brewer to re-appoint Darron Leiker to Place 2 on the 4A Economic Development Corporation with a term to expire July 31, 2022. Motion seconded by Councilor Steve Jackson and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None Wichita Falls Moved by Councilor Whiteley to remove Dave Lilley from Place 5 on the 4A Economic Development Corporation. Motion seconded by Councilor Browning and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, and Whiteley Nays: None Wichita Moved by Councilor Browning to appoint Phyllis Cowling to Place 5 on the Falls 4A Economic Development Corporation. Motion seconded by Councilor Whiteley and carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, and Whiteley Nays: Councilor Jackson Wichita Moved by Councilor Chenault to make the following re-appointments to the Falls 4B Sales Tax Corporation with a term ending July 31, 2021.
