Res 059-2019 Establishing Charter Review Committee 6/18/2019 Resolution No.59-2019 Resolution establishing an advisory Charter Review Committee WHEREAS, one of the strategic goals of the City Council is to review and update the City Charter; and, WHEREAS, to achieve this goal, the City Council desires to establish a Charter Review Committee, to review the various sections of the Charter and make recommendations for changes thereto to the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The Charter Review Committee is an advisory committee and shall be composed of nine voting members hereby appointed by the City Council: Mayor Stephen Santellana Councilor Jeff Browning Councilor Bobby Whiteley City Clerk Marie Balthrop City Attorney Kinley Hegglund Assistant City Manager Paul Menzies Glenn Barham Darrell Coleman Michael Smith A quorum of the Committee consists of five members. The Chairperson of the Committee will be the Mayor of Wichita Falls. The Chairperson will be responsible for running the meetings, setting agendas, and calling for votes on agenda items. The members shall elect from its membership a Vice Chairperson of the Committee. The Vice Chair will perform these duties in the absence of the Chairperson. In the absence of both the Chairperson and Vice Chairperson, the Board shall elect a temporary Chair, who shall preside. An affirmative vote of five members is necessary to take any official action on behalf of the Committee. The City Attorney shall be the primary staff liaison, who will have the responsibility for coordinating meetings, and preparing materials for the membership. The City Clerk shall post meeting notices and maintain minutes of the meetings. The Committee shall be charged to perform the following action plan: 1. Correct typographical errors. 2. Correct antiquated language. 3. Suggest changes when a Charter provision conflicts with state law or court decisions. 4. Suggest changes when a Charter provision conflicts with federal law or court decisions. 5. Suggest changes to resolve internal inconsistencies within the Charter itself. 6. Suggest changes to resolve conflicts between the Charter and the City Code. 7. Perform a full review of all sections of the Charter based on current best practices and possible policy modifications. 8. Present its formal recommendations to the City Council on or before June 16, 2020, so as to allow time for a possible Charter election in November 2020. th PASSED AND APPROVED this the 18 day of June, 2019. ______________________________ M A Y O R ATTEST: ___________________ City Clerk
