RESOLUTION 54-2019
RESOLUTION DESIGNATING SPORTS AND COMMUNITY VENUE PROJECTS IN
ACCORDANCE WITH CHAPTER 334, TEXAS LOCAL GOVERNMENT CODE, AS AMENDED,
DESIGNATING THE METHOD OF FINANCING FOR SUCH VENUE PROJECTS SUBJECT TO
VOTER APPROVAL AT AN ELECTION CALLED FOR SUCH PURPOSES; AND RESOLVING
OTHER MATTERS IN CONNECTION THEREWITH

WHEREAS, pursuant to Chapter 334, Texas Local Government Code, as amended (the
the City Council is authorized to designate
certain sports and community venue projects or venue projects (as such terms are defined in the Act)
and to finance the planning, acquisition, establishment, development, construction and renovation of
such venue projects, subject to approval of the voters in an election called for such purposes;
WHEREAS, this City Council has determined to pursue the planning, acquisition, establishment,
development, construction and renovation of certain sports and community venue projects through the
financing of improvements to such venue projects and related infrastructure and the further financing of
the maintenance and operation of such venue projects; and
WHEREAS, this City Council finds and determines that it is advisable to pursue the holding of an
election in which one or more propositions will be submitted to voters within the City on the financing of the
proposed venue projects;
WHEREAS, Section 334.021 of the Act requires that, prior to calling an election, the City adopt
the proposed method of financing such venue projects;
WHEREAS, Section 334.022 of the Act requires submittal of this Resolution to the Texas
analysis, which state fiscal impact analysis must be completed prior to calling an election on the venue
projects; and
WHEREAS, it is officially found, determined, and declared that the meeting at which this
Resolution has been adopted was open to the public and public notice of the time, place and subject matter
of the public business to be considered and acted upon at said meeting, including this Resolution, was given,
all as required by the applicable provisions of Texas Government Code, Chapter 551.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY THAT:
S1. Designation of Venue Project. The City Council hereby designates and, subject to

approval at an election held in the City, authorizes certain sports and community venue projects to consist
of the planning, acquisition, establishment, development, construction and renovation of one or more venue
projects as permitted by the Act and providing for the financing of such venue projects pursuant to and in

described in summary form as follows:
A. The planning, acquisition, establishment, development, construction and renovation of the
existing Ray Clyme
downtown area of the City;
B. The planning, acquisition, establishment, development, construction and renovation of the
cture in the downtown
area of the City;
C. The planning, acquisition, establishment, development, construction and renovation of the
the downtown area of the City; and
D. The planning, acquisition, establishment, development, construction and renovation of the
downtown area of the City.
The City may combine or group any one or more of the Exhibit Hall, the Coliseum, the Ag Center,
and/or the Auditorium into any one or more desired venue projects as the City may set forth in one or more
election propositions and as may be permitted by the Act or other applicable law.
S2. Designation of the Proposed Method of Financing of the Wichita Falls Venue Projects.
ECTION
The City Council hereby designates the proposed method of financing any one or more of the Wichita Falls
Venue Projects to be the imposition of a tax on the occupancy of a room in a hotel located within the City,
at a rate not to exceed two percent (2%) of the price paid for such room, as and to the extent authorized by
Subchapter H of the Act.
S3. Effective Date; Submittal to Texas Comptroller; Further Procedures. This Resolution

shall become effective immediately upon adoption. Immediately upon adoption, this Resolution shall be
submitted to the Texas Comptroller pursuant to Section 334.022 of the Act. The Mayor, City Manager,
Assistant City Manager, City Clerk, City Attorney and any other officer or agent of the City, and each of
them, shall be and they are hereby expressly authorized, empowered and directed from time to time and at
any time to do and perform all such acts and things and to execute, acknowledge and deliver in the name
of the City all other such documents, certificates and instruments, whether or not herein mentioned, as may
be necessary or desirable in order to carry out the terms and provisions of this Resolution, including the
calling of an election under Section 334.024 of the Act, and taking any other action contemplated by the
Act.
