Min 12/18/2018 City of Wichita Falls City Council Meeting Minutes December 18, 2018 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial with the following members present. Stephen L. Santellana - Mayor Tim Brewer - Councilors Jeff Browning - DeAndra Chenault - Steve Jackson - Eric West - Bobby Whiteley - Darron Leiker - City Manager Kinley Hegglund - City Attorney Marie Balthrop - City Clerk - - - - - - - - Mayor Santellana called the meeting to order at 8:30 a.m. - - - - - - - - Item 2a Invocation Reverend Ed Downing, Love Sanctuary Church of God in Christ, gave the invocation. - - - - - - - - Item 2b Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. - - - - - - - - Item 3a Presentation Recognition of the City of Wichita Falls Housing Division Development 8:32 a.m. Dana Schoening, Director of Community Development, recognized the Housing Division for their High Performer recognition for the Section 8 Management Assessment Program. The Housing Division has received 100% High Performer recognition since 2003. Dana Schoening, Mayor Santellana, and Darron Leiker all thanked the Housing Division staff for their hard work and congratulated them for this honor. - - - - - - - - Item 3b Presentation 2020 Census Jennifer Pope, U.S. Census Bureau 8:36 a.m. Jennifer Pope addressed the council and presented an update on the 2020 Census. Ms. Pope discussed the importance of obtaining correct counts as approximately $1,578 per person is lost in state funding for those not counted. Ms. Pope asked the City of Wichita Falls to form a Complete Count Committee to help convey the importance of the census to our community. This committee will assist with strategies to reach the hard to count individuals in our area. The City of Wichita Falls has eleven hard to count tracts based on the Response Outreach Area Mapper (ROAM). - - - - - - - - Item 4 Consent Items 8:45 a.m. City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Chenault that the consent items be approved. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None Item 4 Approval of minutes of the December 4, 2018 Regular Meeting of the Mayor and City Council. - - - - - - - City Council Minutes December 18, 2018 Page 2 Item 5a Public Hearing and Action on Ordinance 62-2018 8:46 a.m. Conduct public hearing and take action on a request by the applicant to appeal the Planning -25) for a Highway Mayor Santellana opened the public hearing at 8:46 a.m. Dana Schoening, Director of Community Development, presented an overview of the request by the applicant to conditional use permit renewal for property located at 6907 Seymour Highway. Staff recommends approval of the appeal with six conditions to be met within thirty days of the approval and the property to be in compliance with city code within sixty days, or the conditional use permit will be revoked. Mr. Schoening will have discretion to be flexible with the timeline as long as substantial progress is being made. Kerry Wylie, 6907 Seymour Highway, addressed the council and discussed that both of his companies are young companies and time and resources are limited. Mr. Wylie is asking for a little more time to comply with the Ordinance if possible. The portion of the land outside city limits is overgrown and would have to be cleared to be able to use this land. He stated that he was unaware of the ordinance restrictions at the time he purchased the property. Due to the recent snow and rain it is still very wet on part of the property which will cause difficulty in removing two of the trailers. Mr. Wylie stated that removing the roll offs will not be an issue, but he is concerned about getting the fence built and the other trailers moved out within the timeline. Mayor Santellana, and Darron Leiker, City Manager, stated that as long as there is significant progress they are willing to work with the timeline. Mayor Santellana closed the public hearing at 9:06 a.m. Moved by Councilor Browning to approve Ordinance 62-2018. Motion seconded by Councilor Brewer and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West and Whiteley Nays: None - - - - - - - Item 5b Public Hearing for FY 2018 Transit Grant for Capital, Planning and Operating Assistance for the Wichita Falls Transit System. City Council Minutes December 18, 2018 Page 3 9:07 a.m. Mayor Santellana opened the public hearing at 9:07 a.m. John Burrus, Director of Aviation, Traffic and Transportation, addressed the council and gave an overview of the FY 2018 Transit Grant. The grant covers basic operations along with one capital item which is the purchase one thirty-five foot low floor bus. Total state and federal grants for this program is $2.2 million, with a general fund subsidy of $7,700. Mayor Santellana closed the public hearing at 9:09 a.m. - - - - - - - Item 5c Ordinance 63-2018 9:09 a.m. Ordinance appropriating $1,542,861 in Federal Funds and $423,561 in State Funds for the FY 2018 Section 5307 Transit System and $226,324 in State Section 5339 Funds and Authorizing the City Manager to execute all necessary funding agreements related hereto. Moved by Councilor Chenault to approve Ordinance 63-2018. Motion seconded by Councilor Browning and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 5d Ordinance 64-2018 9:10 a.m. Ordinance amending the FY 2019 Public Transportation Budget in an amount of $17,537 for after-hour public transportation services and authorizing the City Manager to execute a memorandum of agreement with Work Services Corporation for financial assistance related to after hour public transportation services Moved by Councilor Chenault to approve Ordinance 64-2018. Motion seconded by Councilor Browning. John Burrus, Director of Aviation, Traffic and Transportation, discussed a three-month test period to provide after hour transportation services. This is in response to multiple requests City Council Minutes December 18, 2018 Page 4 from our citizens. It is a curb to curb service with a proposed $3.00 fare. Services will begin at 5:00 p.m. and end at 12:30 a.m. and run Monday - Saturday. This is a public/private partnership with Work Services Corporation. Motion carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 5e Ordinance 65-2018 9:19 a.m. Ordinance deleting Division 3 of Article III of Chapter 2 of the Code of Ordinances, entitled Veterans Advisory Council, in its Entirety; Reserving Division 3; Reserving Sections 2-172 through 2-200 Moved by Councilor Chenault to approve Ordinance 65-2018. Motion seconded by Councilor West and carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 6a Resolution 131-2018 9:21 a.m. 2020 Decennial Census Program and Pledging Participation in Local Initiatives Including a Complete Count Committee Moved by Councilor Chenault to approve Resolution 131-2018. Motion seconded by Councilor Browning Karen Montgomery-Gagnédiscussed the importance of obtaining a complete count for Wichita Falls and how the census results affect our community at the local, state and City Council Minutes December 18, 2018 Page 5 federal levels. Digital response to the census will be available in 2020, and hopefully will increase the number of responses turned in. Beverly Ellis, 801 W. Rathgeber, addressed the council and stated that she worked with the Houston census prior to moving back in 2011. When she returned to Wichita Falls she found that there were several areas in Wichita Falls that were not counted in the last census. Many that were not counted include minorities and have language barriers. Ms. Ellis offered her services to assist in obtaining a complete count. Motion carried by the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 6b Resolution 132-2018 9:33 a.m. Resolution Authorizing the City Manager to enter into a contract with Cannon Cochran Services Moved by Councilor West to approve Resolution 132-2018. Motion seconded by Councilor Chenault. Christi Klyn, Human Resources Director, discussed that the current third party administrator contract expires at the end of the year. The city accepted bids and five proposals were received with three meeting the minimum criteria. After the review of proposals and reference checks, CCMSI was selected. Councilor Whiteley discussed his dissatisfaction with our previous provider and emphasized that communication is key to help our employees understand the compensation process. Councilor Whiteley acknowledged that this process is complicated but that he wants our fire and police employees to know that if they get hurt on the job they will be taken care of. Julie Saucedo, CCMSI, addressed the council to discuss their services and specifically the Claim Advocacy Model which assists with communication. CCMSI is an advocate of customized communication and staff training prior to the need for services in order to make the process easier for the injured employee. City Council Minutes December 18, 2018 Page 6 Councilor Jackson encouraged Chief Reese and Chief Borrego to encourage their employees to not be afraid to report an on the job injury. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 6c Resolution 133-2018 9:44 a.m. Resolution rejecting all bids for the purchase of eleven (11) 2019 Ford Utility Police Interceptors Moved by Councilor Chenault to approve Resolution 133-2018. Motion seconded by Councilor Brewer. Patrick Halverson discussed the bid process and the availability of the 2019 Police Interceptor vehicles. Ford Motor Company will not be able to fulfill the order, so the Police Department has decided to reject the bid from Ford Motor Company and go out for bids for Chevrolet Tahoes. There was brief discussion about the differences between the two vehicles. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 6d Resolution 134-2018 9:49 a.m. Resolution authorizing the City Manager to enter into an agreement with Secord & Lebow Architects, LLP for Design and Construction Services related to the Wichita Falls Public Transportation Repair and Maintenance Facility in an amount of $685,000 Moved by Councilor Chenault to approve Resolution 134-2018. City Council Minutes December 18, 2018 Page 7 Motion seconded by Councilor Browning. John Burrus, Director of Aviation, Traffic and Transportation, discussed the project timeline, and stated that the project is 100% federally funded. The only local match is the land that is owned by the City. Mr. Burrus praised his staff for their hard work in obtaining the $9.8 million grant for the construction of a new Transportation Repair and Maintenance Facility. Motion carried with the following vote: Ayes: Mayor Santellana, Councilors Brewer, Browning, Chenault, Jackson, West, and Whiteley Nays: None - - - - - - - Item 7 Items of Concern to Members of the City Council 9:55 a.m. Members of the City Council presented the following matters: Councilor Jackson Encouraged all employees to not be afraid to step up and report on the job injuries. Councilor Jackson appreciates the new Third Party Administrator coming on board. Councilor Brewer Stated that his eyes were opened as he went through new council orientation and visited city facilities. He appreciates the staffs time. Councilor Chenault Good morning and thank you for coming out. Thank you to Chief Reese and the Fire Department Christmas Party on Saturday, and thank you to Marjorie Reese and Ann Arnold for the Wichita Falls Christmas party last weekend. Thank you to Chief Borrego for sending officers to handle the accident with an eighteen wheeler that happened in front of my job last week. Merry Christmas and Happy New Year to everyone. Councilor Whiteley Thanks to Chief Reese for party Saturday, and to John Burrus, his wife and his staff for cooking. Your efforts do not go unnoticed and are appreciated. Councilor Whiteley apologized for possibly being abrupt or rude while discussing Councilor West Wanted to publicly thank the city staff and council for all of the cards and kind words for the loss in his family. Asking citizens in District 1 for a little patience as he is behind on answering emails.
