Ord 62-2018 Appeal 6907 Seymour Hwy Overturn Denial 12/18/2018 Ordinance No. 62-2018 Ordinance approving an appeal with conditions of the Planning and (C17- zoning district at 6907 Seymour Highway WHEREAS, the Planning and Zoning Commission denied with a vote of 4 - 4 the proposed conditional use permit renewal on November 14, 2018 to allow a contractors yard in a Residential Mixed Use (RMU) zoning district at 6907 Seymour Highway; and WHEREAS, the applicant appealed the action of the Planning and Zoning Commission and has requested a decision by the City Council; and WHEREAS, after examining the merits of the case, the City Council deems that the renewal application be approved with conditions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. The City Council hereby approves the conditional use permit renewal (Case C 17-25) to allow the land use of a contractors yard in a Residential Mixed Use (RMU) at 6907 Seymour Highway subject to the following development requirements incorporated in this ordinance: a) The property shall be cleared of those items otherwise constituting outdoor storage within 30-days of this approval until such a time that the required screening of such is in place and a formal site plan is submitted, approved, and implemented; and b) The property shall have a fence or other approved screening (6 ft. minimum) in accordance with Section 46- Ordinances installed within 60-days of this approval and maintained in perpetuity to obscure the view of the outdoor storage from any adjacent land or right-of-way. Gates, normally used for access to the /outdoor storage yards, are not required to provide a solid screen; the outdoor storage yard immediately behind and perpendicular to such gate, to a distance of at least 30 feet, shall be kept clear of all storage materials. Unscreened gates shall be no wider than 20 feet; and c) Areas around or under outdoor storage materials or buildings shall be kept free and clear of accumulations of grass, weeds, brush or other uncultivated vegetation; and d) Outdoor storage must be on an improved surface. Gravel surface shall be considered for the outdoor s e) All other site improvements are subject to site plan review process; and f) Should applicant fail to cthe Director of Community Development shall have the authority to terminate this CUP and shall immediately take such action unless applicant has shown substantial compliance. 2.
