Res 049-2011 6/7/2011 RESOLUTION NO. 49-2011 Resolution Authorizing City Staff To Execute All Documents Necessary To Purchase Cellular Wireless Communication Services For The City’s Public Safety Mobile Data System From Verizon Wireless And Sprint MobileIn A Total Amount Not To Exceed $8,357.80 Per Month Through The Texas Department Of Information Resources Purchasing Cooperative, And Provide For The City’s Exit Of Its Mobile Data System Applications From Unlicensed Frequencies Between 902mhz And 928mhz WHEREAS, the City currently operates its Public Safety Mobile Data System (MDT System) on a private network in an unlicensed radio frequency band; and WHEREAS, recently the City has experienced interference on this radio frequency such that the MDT System is not operating effectively; and WHEREAS, tests have been conducted on the network and it has been determined that the most effective solution to the problem is to transition the system from a private network to public cellular networks; WHEREAS, Texas Government Code§ 2054.0565 exempts items purchased through the Texas Department of Information Resources from the State’s competitive bidding requirements as follows: Sec. 2054.0565. USE OF CONTRACTS BY OTHER ENTITIES. (a) The department (Department of Information Resources) may include terms in a procurement contract entered into by the department, including a contract entered into under Section 2157.068, that allow the contract to be used by another state agency, a political subdivision of this state, a governmental entity of another state, or an assistance organization as defined by Section 2175.001. (b) A political subdivision that purchases an item or service using a contract under this section satisfies any other law requiring the political subdivision to seek competitive bids for that item or service. . . . WHEREAS, Verizon Wireless and Sprint Mobile are vendors on the Department of Information Services Cooperative Purchasing Program; and WHEREAS, the City Council finds that these proposed contracts are exempt from the requirements for competitive bidding. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. City staff are authorized to execute all documents and contracts necessary to purchase Cellular Wireless Communication Services From Verizon Wireless And Sprint Mobile in a total amount not to exceed $8,357.80 per month through the Texas Department of Information Resources Purchasing Cooperative for Cellular Communicationsrelated to the City’s Public Safety Mobile Data System. This authorization includes authority to execute contracts with the Texas Department of Information Resources and/or the aforementioned private entities, including, but not limited to, communications technology cooperative contracts and Texas Agency Network contracts to effectuate the delivery of the aforementioned services. 2. The City Manager is authorized to execute all documents necessary to provide for the City’s exit of its mobile data system applications from unlicensed frequencies in the 902MHz and 928MHz band, including, but not limited to, contracts with Oncor by which Oncor will provide consideration to the City in exchange for the City’s exit of said applications from said band and related band areas. th PASSED AND APPROVED this the 7 day of June, 2011. ______________________________ M A Y O R ATTEST: _______________________________ City Clerk
