Ordinance No. 43-2018
Ordinance closing, abandoning, and vacating a 10 foot utility
easement located in Lot 3-B, Block 7, of the Midwestern Park
Addition, aka 4537 Maplewood Ave., Wichita County, Wichita Falls,
Texas, which consists of approximately 2,112 square feet more or
less as depicted and indicated on the attached Survey.
WHEREAS, Wilson Ford Swanson, Jr., property owner of 4537 Maplewood Ave.,
Wichita County, Wichita Falls, Texas, has requested to close, abandon, and vacate
said utility easement located at the East portion of his property,
WHEREAS, all affected City departments and utility companies have reviewed
this request and have recommended conditional approval to close, abandon, and
vacate this utility easement, subject to all utilities being relocated at the expense of the
property owner; and
WHEREAS, it has been determined to be in the best public interest to close,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The utility easement located on the East portion of 4537 Maplewood Ave., as

described above and as depicted in the attached and consisting of
approximately 2,112 square feet, is hereby closed, abandoned and vacated,
subject to any and all utilities being relocated at the expense of the property
owner.
2. It is hereby officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.
3. This will authorize the City Manager to execute a partial easement abandonment
in consideration of $5,279.50 for the cost of the partial easement and $375.00
for the cost of the appraisal.
