Min 07/17/2018 City of Wichita Falls City Council Meeting Minutes July 17, 2018 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial with the following members present. Stephen L. Santellana - Mayor Jesse Brown - Councilors Jeff Browning - DeAndra Chenault - Mitesh Desai - Eric West (8:42 a.m.) - Bobby Whiteley - Darron Leiker - City Manager Kinley Hegglund - City Attorney Marie Balthrop - City Clerk - - - - - - - - Mayor Santellana called the meeting to order at 8:30 a.m. - - - - - - - - Item 2a Invocation Reverend Justin Miller, Trinity United Methodist Church, gave the invocation. - - - - - - - - Item 2b Pledge of Allegiance Mayor Santellana led the Pledge of Allegiance. - - - - - - - - Item 3-4 Consent Items 8:33 a.m. City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Chenault that the consent items be approved. Motion seconded by Councilor Brown and carried by the following vote: Ayes: Mayor Santellana, Councilors Brown, Browning, Chenault, Desai, and Whiteley Nays: None Item 3 - Approval of minutes of the July 3, 2018 Regular Meeting of the Mayor and City Council. Item 4 Resolution 80-2018 Resolution authorizing the City Manager to award bid and contract for the 2018 Alley Rehabilitation Project to MH Civil Constructors, Inc. in the amount of $340,000.00 - - - - - - - Item 5 Public Hearing for ordinance continuing in effect Sections 78-61 through 78-80 of the Wichita Falls Code of Ordinances, which provide a juvenile curfew. 8:34 a.m. Mayor Santellana opened the public hearing at 8:34 a.m. Chief Borrego addressed the council to discuss the necessity of the curfew ordinance. There were no public comments. Public Hearing closed at 8:36 a.m. - - - - - - - Item 6a Ordinance 28-2018 8:36 a.m. Ordinance amending Chapter 46 of the Code of Ordinances by the addition of Article VIII, Temporary Storage Units; and setting an effective date. Applicant: City of Wichita Falls Motion by Councilor Chenault to approve Ordinance 28-2018. Motion seconded by Councilor Desai. Dana Schoening, Director of Community Development, addressed the council to discuss temporary storage units, specifically in residential areas. The recommendation from Planning and Zoning is to approve this ordinance with an effective date of September 1, 2018. Mickey Fincannon, owner of Mi-Box Moving and Mobile Storage, addressed the council and stated that he has worked with Planning and Zoning throughout the process. Mr. Fincannon addressed the sixty-day time limit in the ordinance and stated that he feels like that is not quite enough time especially if the resident is performing a remodel that does not require a permit. The ordinance was originally designed for boxes in the front driveway, and he stated the revised ordinance would now cover back yards as well. The ordinance requires an improved surface for the storage box to set on and he asked that the council take into consideration that most residential properties do not have improved surfaces in the back yard that would meet this requirement. Other than the time limit, Mr. Fincannon agrees with the ordinance and believes it will benefit the citizens of Wichita Falls. Motion seconded by Councilor Desai and carried with the following vote: Ayes: Mayor Santellana, Councilors Brown, Browning, Chenault, Desai, West and Whiteley Nays: None Wichita Falls Motion by Councilor Brown to reappoint Glenn Barham to Place 3 on the 4B Sales Tax Corporation with a term ending July 31, 2020. Jim Dockery, Deputy City Manager, provided a brief history and introduced various associates working with the city on this project. Mr. Tom Small, 2019 Hardin, addressed the council and stated that in talking about these financial matters, it sounds like the city is in great shape, but he wonders if we would not be in greater shape if we had more industry and a few more jobs coming into the city. He stated that he does not know if we need more motels and restaurants, but in his mind we are not finding things that are generating much credit, and it seems like maybe things are not going in the right direction in Wichita Falls. Councilor Brown thanked Mr. Small for his comments. Motion seconded by Councilor Desai and carried by the following vote: Ayes: Councilors Brown, Browning, Chenault, Desai, and Whiteley Nays: None - - - - - - - Item 7c Resolution 75-2018 11:02 a.m. Resolution authorizing the execution of a 15-year lease/purchase agreement in the amount of $2,895,784 with respect to the financing of LED Street Lighting Conversion for the public benefit; authorizing the execution and delivery of the agreement and related documents with Banc of America Public Capital Corp for the acquisition of financing for the project; and resolving other matters relating to the subject Moved by Councilor Chenault to approve Resolution 75-2018. Motion seconded by Councilor Browning. Michael Smith, 4312 Berwick, asked if the lighting met dark skies lighting standards and it was stated that yes the lighting meets these standards. Motion seconded by Councilor Desai and carried by the following vote: Ayes: Councilors Brown, Browning, Chenault, Desai, and Whiteley Nays: None - - - - - - - Item 8 Items of Concern to Members of the City Council 11:26 a.m. Members of the City Council presented the following matters: Councilor Whiteley wanted to bring to the attention of Chief Reese cancer precaution recommendations that were recently handed down from the Texas State Fire Commission NFPA1851 and asked that the department take a look at these recommendations and be proactive about cancer precautions. Councilor Chenault welcomed and thanked everyone for attending the meeting and said hello to Michael Smith former councilor and Mr. Hernandez, one of her customers that attended the meeting for the curfew ordinance. City Council Minutes Page 11 Councilor Brown apologized for Councilor West and Mayor Santellana having to leave the meeting today due to prior engagements. - - - - - - - Item 9 Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda. 11:28 Michael Smith, 4312 Berwick, addressed the council in reference to the Early Childhood Coalition and Resilience and Adverse Childhood Experiences. Mr. Smith works with the Early Childhood Coalition of Wichita Falls and Wichita County, and discussed Adverse Childhood Experiences, which is a new terminology. Mr. Smith invited the city council and public to attend a showing of the one-hour film Resilience and stated that he would make the council aware of upcoming show times. Mr. Smith stated this will lead up to a summit meeting on October 4, 2018 at Grace Church.
