Ordinance Closing The Barwise Street Railroad Crossing To Comply
With Burlington - Northern Santa Fe Railway Company's Closure
Requirement For Installation Of A New Crossing At Kell Boulevard
Service Drive Between Fairway And Barnett Roads, Rescinding The
Closure Of The Granger Street Railroad Crossing, And Authorizing
City Staff To Install End -Of -Road Treatments At Appropriate
Approaches
WHEREAS, Burlington- Northern Santa Fe (BNSF) Railway Company and the
City of Wichita Falls, Texas, have cooperated to promote and enhance new
development by closing less- traveled railroad crossings and thereby facilitating new
crossings in more congested and traveled areas, and BNSF has provided an additional
crossing at Kell Service Drive, conditioned on the City's closure of one crossing at a
different location;
WHEREAS, the City finds that the additional crossing at Kell Service Drive will
enhance new development and increase the tax valuation of the City and therefore is a
municipal public purpose;
WHEREAS, on July 21, 2009, the City Council tentatively closed the crossing at
Granger Street pursuant to Resolution #97 -2009, to be effective after the Kell Service
Drive was constructed, but the closing of the railroad crossing at Granger Street
resulted in delivery problems for a business thereon that could not be cost - effectively
ameliorated; and
WHEREAS, BNSF has indicated that closing the railroad crossing at the Barwise
location will still accomplish BNSF's overall objective of obtaining a crossing closure.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The City Council rescinds Resolution #97 -2009, which directed the closure of
Granger Street (DOT #276363G).
2. Conditioned on rescission of the aforementioned resolution, the City Manager
is directed to close the Barwise Street (DOT # 276571H, Mile Post 114.21, Track ID#
CLIC 9918) railroad crossing to public vehicular traffic, and City staff is authorized to
place end -of -road treatment on the roadway approaches in locations determined by the
City's Director of Public Works to be appropriate. The aforementioned end -of -road
treatments may be installed on the part of Barwise depicted as " Barwise St. section to
be closed" in the attached Map A or Map B, effectively closing said section of street to
public vehicular traffic upon placement of said treatments, as long as said treatments
are maintained at said locations. A smaller section of street may be closed to public
travel in the discretion of the City's Director of Public Works.
3. Upon a change in conditions allowing the Granger Street or other railroad
crossings to be closed in replacement of this crossing closure, the City Manager may
re -open the Barwise Street crossing and closed street section therein.
4. This ordinance is not intended to abandon or transfer property rights held by
the City to the Barwise Street Crossing or closed section of street to any other party.
