Res 019-2006 2/7/2006 RESOLUTION NO. I �� ���lJ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, REGARDING POSSIBLE TERMINATION OF THE OPERATION AND MAINTENANCE AGREEMENT WITH THE MULTI- PURPOSE EVENTS CENTER CORPORATION; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, on September 12, 1994, the Multi-Purpose Events Center Corporation ("Corporation") entered into a five-year Operations and Maintenance Agreement for the MPEC facility with the City of Wichita Falls ("City") and Wichita County ("County"); and, WHEREAS, in September 1999, the Operations and Maintenance Agreement was renewed for an additional five-year period, ending in September 2004; and, WHEREAS, since 2004, the agreement has been continued by the parties on a month-to-month basis; and, WHEREAS, the MPEC Corporation Board has adopted a formal resolution asking the City to review the possible termination of the existing Operation agreement; and, WHEREAS, the City believes there is good and sufficient reason the MPEC facility should be managed and operated by the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Manager is hereby asked to review the appropriate procedures and timeframes necessary for the transfer of existing permits and contracts currently held by the MPEC Corporation for the operation of the MPEC facilities, including the permits necessary for the sale of alcoholic beverages. The City Manager is further authorized to apply for new permits in the name of the City of Wichita Falls for the sale of alcoholic beverages at the MPEC facilities if the current permits for the sale of alcoholic beverages cannot be transferred. SECTION 2. The City Manager shall report to the Council of his findings regarding the transfer of permits and shall further provide the Council with a target date for the termination of the current Operations and Maintenance Agreement. SECTION 3. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law.
