RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, ACCEPTING THE LAKE KEMP RAW WATER SUPPLY
SYSTEM PROJECT (CWF04-544-24) AND APPROVING CHANGE
ORDER NO. 4; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with S.J. Louis
Construction, LTD with an estimated cost of $8,961,740.85; and
WHEREAS, Change Orders No. 1 through 3 added $10,318.30 to the contract,
for a revised cost of $8,972,059.74; and
WHEREAS, Change Order No. 4 will add $724,293.65 to the contract, for a
revised contract amount of $9,696,353.39; and
WHEREAS, the actual work was completed at a total cost of $9,753,307.65, of
which $9,306,601.52 has been previously paid to the Contractor, leaving an amount
due of $446,706.13; and
WHEREAS, the City Staff has inspected the work and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Change Order No. 4 is hereby approved.
SECTION 2. The Lake Kemp Raw Water Supply System Project (CWF04-544-
24) is hereby accepted and the City Manager is authorized to make final payment to the
Contractor.
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
