RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AUTHORIZING FINAL PAYMENT TO KANZA
CONSTRUCTION, INC.; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered into a contract with Kanza
Construction, Inc., with the estimated total cost of $3,105,517.00; and
WHEREAS, change orders have been previously approved, totaling
$393,389.00; and
WHEREAS, the actual work was completed at a total cost of $3,498,906.00, of
which $3,149,803.00 has been previously paid to the Contractor; and
WHEREAS, the Contractor incurred 185 days of liquidated damages, for a total
amount of $92,500.00; and
WHEREAS, the amount due to the Contractor is $256,603.00; and
WHEREAS, the work has been inspected and found to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Phase II Airfield Improvements Kickapoo Downtown Airpark is
hereby accepted, and the City Manager is authorized to make final payment to the
Contractor.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
