RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, REGARDING THE MEET AND CONFER PROCESS, AS
ESTABLISHED BY CHAPTER 142 OF THE TEXAS LOCAL
GOVERNMENT CODE; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Texas Legislature during its 79 Regular Session, enacted a law
allowing a Meet and Confer process for certain qualified municipalities; and,
WHEREAS, on May 16, 2006, the voters approved a ballot proposition
authorizing Meet and Confer between Local 432 of the International Association of
Firefighters and the City of Wichita Falls; and,
WHEREAS, Chapter 142 establishes that Meet and Confer negotiations shall be
befinreen the City Manager as the sole and exclusive bargaining agent for the City, and
the individuals designated by Local 432 as their exclusive bargaining agent; and,
WHEREAS, under Chapter 142, the role of the City Council is to approve or
disapprove any written agreement which may be proposed by the respective bargaining
agents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City Council recognizes the role of the City Manager as the
sole and exclusive bargaining agent for the City of Wichita Falls. The members of the
City Council will therefore not engage in individual discussions with the bargaining
agents of Local 432 regarding wages, hours of employment, and any other terms and
conditions of employment herein.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
