RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, APPROVING THE SETTLEMENT OF BLOODWORTH
V. CITY OF W/CHITA FALLS AND REPUBLIC INSURANCE V. CITY OF
WICHITA FALLS, AND AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY SETTLEMENT DOCUMENTS; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls is a party in pending lawsuits styled Joe
Dan "Jody" Bloodworth, Margaret B/oodworth Bond, and 8& 8 Cattle Co., a Texas
Partnership v. City of Wichita Falls, Texas (Cause No. 93-10-0140A-CV, in the District
Court of Archer County, Texas, 97 Judicial District), and Republic Insurance Co. v.
City of Wichita Falls Texas (Cause No. 01-01768-D; In the District Court of Dallas
County, Texas, D-95 Judicial District); and,
WHEREAS, the parties in both lawsuits have reached a settlement of all pending
matters in the litigation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Wichita Falls City Council approves the settlement of Joe Dan
"Jody" B/oodworth, Margaret Bloodworth Bond, and 8& 8 Cattle Co., a Texas
Partnership v. City of Wichita Falls, Texas, and Republic Insurance Co. v. City of
Wichita Falls, Texas, under terms as identified in the prospective settlement
agreements.
SECTION 2. The City Manager is hereby authorized to execute the necessary
settlement agreement for each case, after approval as to form by the City Attorney.
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
