RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, TO ACCEPT THE 2005 STREET REHABILITATION
PROJECT, CWF05-100-24 AND AUTHORIZE FINAL PAYMENT TO
ZACK BURKETT, CO.; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with Zack
Burkett, Co. with the estimated total cost of $1,519,440.00; and
WHEREAS, the actual work was completed at a total cost of $1,488,475.33 of
which $1,414,051.56 has been previously paid to the contractor; and
WHEREAS, the Contractor has incurred 91 days of liquidated damages totaling
$45,500.00; and
WHEREAS, with the deduction of liquidated damages leaves a balance due to
the Contractor of $28,923.77; and
WHEREAS, the City staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The 2005 Street Rehabilitation Project, CWF05-100-24 is hereby
accepted, and the City Manager is authorized to make final payment to the contractor.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
