RESOLUTION NO. 11�-�d0lp
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, TERMINATING THE OPERATIONS AND
MAINTENANCE CONTRACT WITH THE MULTI-PURPOSE EVENT
CENTER CORPORATION; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, on September 12, 1994, the Multi-Purpose Events Center
Corporation ("Corporation") entered into a five-year Operation and Maintenance
Contract for the MPEC facility with the City of Wichita Falls ("City") and Wichita County
("County"); and,
WHEREAS, in September 1999, the Operation and Maintenance Contract was
renewed for an additional five-year period; and,
WHEREAS, since 2004, the contract has been continued by the parties on a
month-to-month basis; and,
WHEREAS, the City of Wichita Falls has been issued permits by the Texas
Alcohofic Beverage Commission for the sale of alcohol at the MPEC facilities; and,
WHEREAS, the Corporation, by adoption of Resolution No. 19-2006, asked the
City and County to review the possibility of terminating the existing agreement, and
allowing the facilities to be operated by the City; and,
WHEREAS, after reviewing all matters related to the operations of the MPEC
facility, the City believes it is in the best interests of the citizens of Wichita Falls to
terminate the existing Operation and Maintenance Contract and assume responsibility
for operation of the facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The existing Operation and Maintenance Contract between the
Multi-Purpose Events Center Corporation and the City of Wichita Falls and Wichita
County is hereby terminated. The termination shall become effective upon the adoption
of this resolution by the City and similar official action by the Commissioners Court of
Wichita County.

SECTION 2 . Notice of this resolution shall be sent to the Board of Directors of
the Multi-Purpose Events Center Corporation and the Commissioners Court for Wichita
County.
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
