RESOLUTION AUTHORIZING THE PURCHASE OF A 7.20 ACRE
TRACT OF LAND OR A 10.17 ACRE TRACT OF LAND OUT OF BLOCK
43, KEMP AND NEWBY SUBDIVISION OF CHEROKEE COUNTY
SCHOOL LAND, ABSTRACT NO. 33, WICHITA COUNTY, TEXAS, AND
BEING OUT OF A 39.688 ACRE TRACT CONVEYED TO DAN GRAY
AND BILL MCGREGOR BY DEED RECORDED IN VOLUME 2762,
PAGE 373, OF THE OFFICIAL PUBLIC RECORDS OF WICHITA
COUNTY, AS INDICATED ON THE ATTACHMENT "A" LOCATION MAP
AND ATTACHMENT "B" FIELD NOTES FOR THE PURPOSE OF THE
RUNWAY PROTECTION ZONE SOUTH OF KICKAPOO AIRPORT;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the Federal Aviation Administration (FAA) has recommended the
City purchase at least a 7.20 acre tract of land for the purpose of a runway protection
zone south of Kickapoo Airport; and
WHEREAS, the City Council of the City of Wichita Falls, Texas, deems it
reasonable and in the public interest to purchase either the 7.20 acre tract of land or the
10.17 acre tract for and RPZ zone.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The amount of just compensation to be offered to the property
owners will be the "fair market value" as determined by the appraisals.
SECTION 2. In the event the property administrator is unable to purchase the
parcel for the appraised value, the property administrator is authorized to institute
condemnation proceedings to obtain such property in the name of the City of Wichita
Falls for the purpose of a Runway Protection Zone (RPZ).
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
