ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, CALLING AN ELECTION FOR THE ISSUE IF
RECOGNITION OF LOCAL 432 OF THE INTERNATIONAL
ASSOCIATION OF FIREFIGHTERS AS THE SOLE AND EXCLUSIVE
BARGAINING AGENT FOR THE NON-EXEMPT EMPLOYEES OF THE
WICHITA FALLS FIRE DEPARTMENT FOR THE PURPOSE OF MEET
AND CONFER, AS PROVIDED BY CHAPTER 142 OF THE TEXAS
LOCAL GOVERNMENT CODE; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, on September 20, 2005, the City of Wichita Falls received a petition,
asking the City Council to recognize Local 432 of the International Association of
Firefighters as the sole and exclusive bargaining agent for the non-exempt employees of the
Wichita Falls Fire Department; and,
WHEREAS, on October 18, 2005, the City Council ordered a certification election to
determine whether Local 432 of the International Association of Firefighters represented a
majority of the covered firefighters; and,
WHEREAS, by election conducted on November 8, 9 and 10, 2005, 116 firefighters
voted "yes" to the ballot question whether Local 432 of the International Association of
Firefighters represented them as the sole and exclusive bargaining agent under Chapter
'I42 Of tf12 TEXAS LOCAL GOVERNMENT CODE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. The issue of whether the City may meet and confer with Local 432 of
the International Association of Firefighters should be submitted to the voters at the next
general municipal election as authorized by Chapter 142 of the Texas Local Government
Code.
SECTION 2. It is hereby officially found and determined that the meeting at which
this ordinance was passed was open to the public as required by law.
