ORDINANCE NO. `��
ORDINANCE CLOSING, VACATING, AND ABANDONING THE RIGHT-
OF-WAY OF KEITH STREET LYING BETWEEN LAWRENCE ROAD
AND THE FORT WORTH AND DENVER RAILROAD; AUTHORIZING
THE CONVEYANCE OF THE PROPERTY TO THE FEE OWNER;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, Paul Blackburn, of McGrath/Quail Creek Crossing LTD, has
requested the closing, vacating and abandoning of Keith Street right-of-way; in
exchange for dedicating right-of-way for the Maplewood Avenue extension, and
WHEREAS, the final approval of this street closure is conditioned upon all
affected City departments and utility companies approval and subsequent filing of the
said plat within one year; and
WHEREAS, the City Council of the City of Wichita Falls, Texas, has established
the Tax Increment Financing District, Reinvestment Zone #2 for the purpose of
improving public infrastructure in the District including the improvement of the
Maplewood Extension and the widening of Lawrence Road; and
WHEREAS, the City Council of the City of Wichita Falls deems it reasonable and
in the public interest to close, vacate, and abandon this hereinafter described right-of-
way subject to the conditions herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The 60-foot wide by approximately 1140-foot long section of Keith
Street right-of-way containing approximately 68400 square feet, located befinreen the
east right-of-way line of Lawrence Road and the west right of line of the Fort Worth and
Denver Railroad, as indicated on the attached map, is hereby closed, vacated, and
abandoned subject to the conditions of Section 2. Said attached map labeled
"Attachment A" shall be incorporated into, and become a part of, this ordinance.
SECTION 2 . This ordinance shall authorize the City Manager to execute a
quitclaim deed for the City's interest in the property. The deed shall be executed
conditioned upon the property owner's filing of an approved re-plat of the property in the
records of the Wichita County Clerk. The re-plat shall include dedication of right of way
for the Maplewood Avenue Extension. This filing shall occur within one (1) year of the
date of approval of this ordinance.

SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
