ORDINANCE NO. �aW
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, CLOSING, ABANDONING, AND VACATING RIDER
AVENUE, ALSO KNOWN AS GLENDALE AVENUE, BETWEEN
COLUMBIA ROAD AND FAIRWAY BOULEVARD; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Bill Swan of Two Bills, Inc. has requested the City close, abandon,
and vacate Rider Avenue, also known as Glendale Avenue; and
WHEREAS, all affected City departments and affected utility companies have
been contacted and have approved or conditionally approved this closure with the filing
of an approved replat; and
WHEREAS, the City Council of the City of Wichita Falls, Texas, deems it
reasonable and in the public's best interest to close, abandon, and vacate this portion of
Rider (Glendale) Avenue hereinafter described, subject to application being made and a
final replat submitted to the City within one year of the date of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . The street called Rider Avenue, also known as Glendale Avenue, is
hereby closed, abandoned, and vacated as indicated on the final plat (Attachment "A").
The total abandonment is equal to 16,168 square feet.
SECTION 2. In consideration of the receipt of $13,015.00 for the value of the
street to be closed, and $1,300.00 for the cost of the appraisal, this ordinance shall
authorize the City Manager to execute a quitclaim deed for the City's interest in the
property. The deed shall be executed conditioned upon the property owner's filing an
approved replat of the property in the records of the Wichita County Clerk. This filing
shall occur within one (1) year of the date of approval of this ordinance. The replat shall
comply with the requirement of the Planning and Zoning Commission and shall include
the dedication of new street right-of-way.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
