ORDINANCE REZONING AMENDING SECTION 6127 OF APPENDIX B,
ZONING, OF THE CODE OF ORDINANCES, TO ALLOW THE EXPANSION OF
A NONCONFORMING USE IN A SINGLE FAMILY DISTRICT; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission considered the proposed
zoning amendment at their May 10, 2006, meeting and voted to recommend approval
of this change; and
WHEREAS, City Council concurs with this recommendation and has determined
that the herein described amendment is in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Code of Ordinances, Appendix B, Zoning, Section 6127
Nonconforming Uses—Expansion, is hereby amended by adding the following
underlined text and deleting the strikethrough text:
An existing nonconforming use may be expanded, extended or enlarged subject to the
Conditional Use approval process provided in Section 7200 as long as all other
provisions of the Zoning Ordinance including, but not limited to, building coverage,
landscaping, and parking requirements, are met. The expansion must be on the same
lot where the nonconforming use is located. However, additional property may be used
as a parking area.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
