ORDINANCE CLOSING, ABANDONING, AND VACATING A TEN FOOT
UTILITY EASEMENT CROSSING THE REAR PORTION OF 3108
SOUTH DRIVE CONTAINING APPROXIMATELY 2,875 SQUARE FEET
AS INDICATED IN THE ATTACHED EXHIBIT "A" TO ALLOW
PROSPECTIVE BUYERS TO ACQUIRE A LOAN TO PURCHASE SAID
PROPERTY; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the current property owners of 3108 South Drive have requested to
close, abandon, and vacate that portion of a ten-foot utility easement across the rear
portion of their property as indicated in Exhibit " A"; and
WHEREAS, all affected utility companies and City departments have reviewed
this request and have recommended approval of this closure; and
WHEREAS, The City Council of Wichita Falls, Texas deems it advisable and in
the best public interest to close, vacate, and abandon that portion of the utility
easement herein indicated in Exhibit "A".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That the approximately 2,875 square foot utility easement known as
3108 South Drive and dedicated on the plat of Lots 13 and 14, Thompson-Hamlin-Davis
Subdivision, and 0.066 acre out of Homestead No. 33, Wichita Gardens Homesteads,
an addition to the City of Wichita Falls, is hereby closed, abandoned and vacated. Said
easement is shown as indicated on the attached Exhibit "A" map and incorporated in
this ordinance.
SECTION 2. That in consideration of the receipt of $1,380 for the cost of the
property and $150.00 for the cost of the appraisal, this ordinance shall authorize the
City Manager to execute a quitclaim deed for the City's interest in the property. The
deed shall be executed conditioned upon the property owners filing an approved re-plat
of the property in the records of the Wichita County Clerk. This filing shall occur within
ninety days of the date of approval of this ordinance. This ordinance shall be void and
have no effect if said re-plat is not approved and filed within the stipulated time period.

SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
