Item 1
The City Council of the City of Wichita Falls, Texas met in regular session on the above
date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the
following members present:

Mayor called the meeting to order.
Item 2a
Willie Howard, Lay Minister, Maurine Street Church of God, gave the invocation.
Item 2b
Councilor Gonzalez led in the Pledge of Allegiance.
Item 3
Jerry Vandiver informed that Mrs. Pat Haywood, Clean Community Commission member,
would be making a power point presentation on the Clean Community Commission. Mrs.
Haywood gave a brief history of the Clean Community Commission, their current purposes, past
and present projects and future plans. She informed organizations on what they can do to help in
these clean up and beautification efforts. She encouraged everyone to participate individually or
jointly to keep Wichita Falls a clean community.
The Falls Fest Steering Committee presented the City a check in the amount of$5,195,
City's portion of the proceeds from the 2005 Falls Fest. Kathryn Early and Paula Perkins
presented the check and expressed appreciation to the City for their sponsorship and all the
departments for their assistance during Falls Fest.
Item 4
Laura Nix, 1512 Britain, spoke on behalf of the Bill of Rights Defense Committee/Patriots
Act. She expressed concern that some of the provisions of the Patriot Act have begun to erode
some of our civil rights. She mentioned the Gettysburg Address and its words, in particular, that
"all men are created equal" and that "These will not have died in vain as long as long as the
government of the people, for the people, and by the people does not perish". Our concern is that
there is a move for more centralization of government and a diminishment of our personal rights.
We do not want our police officers going into homes without warrants and tapping phones or doing
other things that are beginning to infringe on our rights. We are the people and this is our
government, for the people, and by the people; and we want to keep it that way.

Councilor Ginnings asked what she thought the proper response would be to those who do
not hold the values of a government of the people, by the people and for the people; and the
concern that President Lincoln had when he said "shall not perish from the earth". Not only that
they do not value them but would destroy them. What do you think would be a proper response?
Mrs. Nix responded that when we protect our rights and things continue according to
standard procedure, obtaining warrants, we are less likely to have people who are guilty by
association and not guilty themselves being arrested. Many people ended up in Guantanamo
because of their race. We need to protect the rights of people and use proper means,
constitutional means to go after those who are guilty of infringing on the rights of others.
Ben Valadez, Jr. 4815 Del Rio Trail, expressed appreciation to the Council and Staff for
listening to his plight and for taking care of his needs. He also spoke in favor of naming a street in
honor of Martin Luther King, Jr.
Brenda Jarrett, 22871 Count Line Road, expressed her views about City government in
Wichita Falls. She listed issues/projects she had been involved in relating to the City, such as the
Isis Carver Theater, Youth Opportunity Center, Weed & Seed Program, etc. She mentioned that
the Police Training Center was not received well by the area residents because of its location and
how it was built without input from the residents. Renovation of the Holt Hotel's history was
restored. The Booker T. Washington Building was sold and done in a dishonest manner. She felt
that saving this property is important to the health and healing of this community. The City tells me
they cannot do anything during Black History month. I think the City just does not want to do
anything to help. WFISD closed Booker T. Washington School; almost every city has a street
named after Martin Luther King, Jr. The momentum was 30-40 years ago and we are behind. We
did not have a civil rights movement here. It flew over. You reap what you sow, justice prevails and
good will win over evil. Collective conscience here in Wichita Falls is an energy that breathes
injustice, division, and apathy. Is this the Jim Crow stuff? If anyone goes against status quo you
are ostracized.
Valerie Rhodes, 1706 Avalon, asked for an opportunity to speak at this time on an item that
was on the agenda because she had to go to work. She spoke in favor of naming a street after
Martin Luther King, Jr. but was opposed to renaming Eastside Drive after Dr. King, and she
suggested renaming Loop 11 after Dr. King.

Councilor Ginnings asked if the ATCO deal was a lease. City Manager replied that they
were leasing from the 4A Corporation.

ORDINANCE NO. 13-2006
ORDINANCE RENAMING NORTH EASTSIDE DRIVE AND EASTSIDE DRIVE TO
NORTH MLK JR. DRIVE AND MLK JR. DRIVE RESPECTIVELY; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW
Moved by Councilor Roberts-Burns that Ordinance No. 13-2006 be passed.
Motion seconded by Councilor Gonzalez.
Lindsey Walker, 1411 Trout, reported on what the Community Action Committee
had done to research and survey, not only the Eastside residents but the entire community
on the renaming of Eastside Drive to MLK Drive. The majority are in favor of this. Those
that are complaining about this did not show up at the community wide meeting to express
ideas. We have stepped forward and done what needed to be done and we are asking
that the Council act on this today and name Eastside Drive as MLK Drive.
Margaret Crittendon, 1308 Eastside Drive, does not have a problem with naming a
street after Martin Luther King, Jr. but has a problem with stereotyping people. She said
nothing is going to change except the name of a street. We need to address the changes
that need to take place there.
Murray Sallis, 1614 Collins, agreed that the name change is not going to make any
difference no matter what you call Eastside Drive. What needs to happen there is to
provide incentives for business owners to place infrastructure and money in that area. Fix
the area and make positive changes; change the way it looks and make it better. Eastside
has a negative connotation, but it is not their fault.
Councilor Elmore took exception to Mr. Sallis statement in that the name change
will make a significant difference. The recognition of Dr. King depicts a pride in the
residents of the area. The City cannot direct economic advantages; we cannot tell a
businessman where to put his business. Economic development comes from the residents
in a certain area that draws it to them. I think this will make a significant difference.
Councilor Ginnings asked if there were Code violations on Eastside Drive. Mr.
Clark replied that there possibly were. Councilor Ginnings felt that the citizens also needed
to be diligent and vigilant in that area to see it does not deteriorate. He stated that the City
needs to give attention to correct the Code violations.
Councilor Roberts-Burns felt it was time that we change and have a Martin Luther
King Boulevard. This will give us a new change to bring new business to this area.
Councilor Ginnings clarified that he was speaking only of Eastside Drive when he
mentioned the Code violations.
David Brock, 320 Hill Top, stated that Eastside Drive is a boulevard and should be
boulevard, not drive.
Moved by Councilor Norrie to amend the proposed ordinance by replacing the word
"Drive" with the word "Boulevard", the renaming would be MLK, Jr. Boulevard.
Motion seconded by Councilor Elmore and carried by the following vote.

Item 9a
Mr. Scott Taylor gave an update on the water improvement projects.
Item 9b
Councilor Roberts-Burns thanked Mr. Lindsey Walker and the Community Action
Committee for the work they did on the renaming of Eastside Drive to MLK, Jr. Boulevard.
Councilor Elmore thanked citizens and staff who attended his district meeting.
Councilor Ginnings asked about the Expert Tire offer for tire recycling facilities. City
Manager stated that we are considering that request and that information has been turned over to
Mr. Scott Taylor.
Councilor Ginnings mentioned that repeated burglar alarm calls can impose a fine or a fee
that applies to homes, and then he mentioned the shootout that occurred this weekend in the City.
He stated that there were repeated calls to the Police Department from businesses and
residences, however, when the police respond, they do not receive any cooperation because no
one has seen or heard anything. He asked staff, in particular the City Attorney, to present to the
Council an ordinance defining businesses, residences or properties involved in multiple violent
incidents that the police are called to. He suggested that the ordinance provide for fines and
conditions that would invoke eviction or closure of the business but at least fines. It seems to me if
there are fights or gun shots that come from a location twice a month, that is a nuisance and that
is what I am looking at. You might consider grading the type of offense. One incident like that
might be a situation that would trigger the fine. This is something that the City Attorney has
furnished us examples of ordinances in other cities. He wants the City Attorney to present one to
Council for their consideration. This is meant to assist police and to promote a safer community. I
would like for us to posture ourselves, within the law, to demonstrate that the City of Wichita Falls

does not want these people here and make it advantageous for them to go somewhere else. City
Manager stated that Staff will prepare something.
Councilor Gonzales asked if the policy that employees must live within twenty minutes of
the City was being verified. City Manager replied that it is an administrative policy and we try to
verify that, however if he or anyone else was aware of an employee who lives outside that twenty
minute period to notify him or Mr. David Winney.
Councilor Ammons asked if anyone had been arrested on the weekend shootings. Chief
Bachman informed that several persons had been arrested but not the shooters. We are
investigating and that takes a while.
Councilor Ammons asked about outside storage permits. Mr. David Clark informed that
there are some areas that have no clarity like salvage yards. There is some room for examination
of the ordinances regarding outdoor storage. I think there is a problem out there that requires a
change. We will look at both commercial and residential.
Mayor Lyne expressed appreciation to the staff who attend the town hall meetings. It is
good to have staff there to answer questions.
Mayor mentioned a compliment that he had passed on to employee Jerry Blowers, and
stated that he likes to pass on those types of pats on the back to the employees. He appreciates
the work done on the nepotism issue.
Mayor reminded that Friday will be the final Strategic Planning Meeting.
