Min 04/04/2006 749 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building April 4, 2006 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present: Lanham Lyne - Mayor Ray Gonzalez - Mayor Pro Tern Jim Ginnings - Councilors Linda Ammons - Dorothy Roberts-Burns - Michael Norrie - Charles Elmore - Darron Leiker - City Manager Bill Sullivan - City Attorney Lydia Ozuna - City Clerk Mayor called the meeting to order. Item 2a Pastor Bill Jackson, Victory Baptist Church, gave the invocation. Item 2b Councilor Gonzalez led in the Pledge of Allegiance. Mayor moved Item 3e to be discussed at this time. Item 3e Mayor proclaimed April 4, 2006 as "Tito and Elvie Tolentino Day" in Wichita Falls. Mr. and Mrs. Tolentino are goodwill ambassadors for the people of Wichita Falls and the Kingdom of Belgium. They are ENJJPT sponsors welcoming and hosting new international students and staff at Sheppard Air Force Base. They were knighted by Belgium as Ambassadors for their help. Sheppard Air Force Base Colonel Jeffrey B. Kendall, 80th Flying Training Wing Commander, expressed appreciation to Mr. and Mrs. Tolentino for their excellent leadership roles; they exemplify what it means to be ENJJPT sponsors. He thanked Council for recognizing them and their talents; they are part of our Hall of Fame. Councilor Norrie stated that Elvie and Tito are very involved in mission trips and they give unselfishly of their time, talents, and resources. Mr. Tolentino displayed the beautiful medal presented to them from Belgium. He thanked everyone for being here and for the recognition honoring them today. Item 3a Mayor recognized Mr. Glenn Wharf, Line Technician II, Kickapoo Downtown Airpark, as employee of the month for April 2006. Mayor presented Mr. Wharf with a plaque, a check, dinner for two, and golf course passes. 750 Item 3b Mayor proclaimed the month of April as "Child Abuse Prevention Month" in Wichita Falls. Numerous Non Profit Children's' organizations were represented such as Patsy's House, Child Advocates, and Child Protective Services. Mayor encouraged the recognition of compassion and professionalism of those who bring a ray of light to these children. Item 3c Mayor presented Kathye O'Connor with the Patsy Baggett Children's Service Award for her untiring services to the children of Wichita Falls and for speaking out against child abuse. Kathye O'Connor accepted the award and expressed appreciation to all who are part of this program to help one child at a time. Item 3d Mayor proclaimed April 9-15, 2006 as "Small Business Month in Wichita Falls". Item 3f Mayor proclaimed April 3 - 7, 2006 as "National Public Health Week" in Wichita Falls and encouraged citizens to extend a hand of appreciation to our Public Health workers. Item 3g Mr. Mike Edgin, Edgin, Parkman, Fielding & Fielding PC, presented the Comprehensive Annual Report and the single audit reports and commended the Finance Department for their work. Item 4 Lisa Gunnell, 3631 Maplewood #2, President of the North Texas Rural Rail Transportation District Board, mentioned a property located on the southwest part of the City. They want to improve it so that everyone can enjoy it. They are working on a grant and have to raise $20,000 to qualify. They have submitted a proposal to Council, which could be eligible as a 4B project. The Board is asking for Council's guidance and assistance. Sister Josephine Stewart, 2820 Lansing, asked Council to pass a resolution to protect our citizens against sections in the Patriot Act that invade our personal rights. She will submit that to the Council and they will decide whether to put it on the agenda. Richard Schlomach, 2200 Harrison, complained about the garbage collection rates being too high. He mentioned the difference in rates between Camelot Apartments at $5.22 per apartment and his duplex at $11.00 per apartment. Mr. Scott Taylor will look into this. Item 5 The Minutes were approved as distributed. Items 6a-6d City Manager gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Ammons that the Consent Agenda be approved. Motion seconded by Councilor Gonzalez and carried by the following vote. 751 Items 6a-6d continued Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Norrie, Gonzalez, and Elmore Nays: None Minutes of the following board and commission meetings were received (a) Planning & Zoning Commission —January 11, 2006 (b) Traffic Safety Commission— February 1, 2006 (c) Planning & Zoning Commission— February 8, 2006 (d) Park Board — February 23, 2006 Item 7 A public hearing was held to determine if certain buildings and/or structures are dangerous. Mayor declared the public hearing open. Mayor stepped out of Council Chambers and Mayor Pro Tern Gonzalez presided. Mr. Dave Clark explained that Council has the option of a Restoration Permit where the property remains on the demolition list but a Building Permit can be issued, which assures that the property does get repaired. 1308 Austin - Mr. Haywood Beasley informed that he is going to tear the structure down today but needs to have time to get money to clear the debris. Mr. Clark informed that there is an automatic 30 day time frame so Council can leave the property as is and it will take care of itself. 1604 Kemp - Mrs. Rita Miller informed that this applies only to the garage and access building. Owner wants to rehab primary structures and staff is okay with that. 3000 Cumberland — Mrs. Miller informed that there is a $4,600 lien on this property. Mrs. Josie Rose, 608 Woods, stated that she is in the process of purchasing this property and requested 90 days to repair and then do an inspection and allow her an extension to complete the job. Councilor Norrie said neighbors have expressed concern that this is going to be another delay and nothing will be done. He said they had been threatened not to come to City Council to talk about this property. He could not believe this has been on the books since 1985. Mrs. Rose asked for 30 days to acquire the property and renew her license. She could get a licensed contractor to pull the permit in the interim. Staff recommended that a Restoration Permit be applied on this property. City Attorney noted that Mrs. Rose is not the property owner so Council should ask that before any permit is issued that she show proof of ownership, then deal with a permit. If the property is sold and she takes out a permit within the appropriate time lines, then that is fine. I would like to make sure that the legal owners come forward. He suggested that a certain time limit be given that if a transfer is to take place then the new owner takes out the permit, then makes substantial improvements to that property. If either of those fail within the time frame, the property would be demolished. 1306 North 7th —Owner deceased. No probate. 1604 Kemp — Cynthia Gylov, 3214 Milby, informed that they will tear down the garage and access building within 30 days and will rehab the primary building in 6 months. 1201 North 9th— Owner will demolish access building. 2812 Old Iowa Park Road — Mrs. Miller stated that there is a high level of concern on this property. 752 Item 7 continued Mr. Roland Marchand, Trustee for the property, informed that they are ready to demolish. 721 Powell — Mrs. Miller stated this is the garage only. There is an electric meter attached to the garage and it will need to be removed. City Attorney noted that before Code can enter a building, it has to be vacant and then brought to Council for action. Mrs. Miller informed that the house was currently occupied. 1020 Sunset — Mrs. Miller noted that they receive ongoing complaints from neighbors. This property continues to be an issue. 3312 Burkburnett — Councilor Elmore asked if the City could purchase this property. Dave Clark informed that we could attempt foreclosure through taxes. Then it goes to a Sheriff's sale and then into a trustee situation. Councilor Ammons felt it could be sold without the structure. Councilor Ginnings asked why we let these properties build up. Mr. Clark replied that we spend pretty much spend the money we have for demolition. As you know these properties keep coming and different attention is given to them. We try to get to them as soon as we can. We are not the folks who would do the tax delinquent process. Councilor Ginnings commented that maybe the tax people could watch the Council meetings and know they are not doing their job. Council expressed concern that hazardous properties are sitting there too long. Mayor suggested a review process to keep moving these property concerns. We need the public to let us know and the occupancy is another issue. City Attorney informed that Mrs. Pat Hoffman is making it a priority to speak with Harold Lerew to discuss these issues. Mayor called for additional public comments. There being none, Mayor declared the public hearing closed. City Council recessed at 9:55 a.m. and reconvened at 10:15 a.m. Item 8a ORDINANCE NO. 20-2006 ORDINANCE FINDING CERTAIN BUILDINGS AND/OR STRUCTURES TO BE DANGEROUS; COMMANDING PROPERTY OWNERS TO DEMOLISH SAID BUILDINGS AND/OR STRUCTURES WITHIN THIRTY (30) DAYS OF THE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Roberts-Burns that Ordinance No. 20-2006 be passed. Motion seconded by Councilor Gonzalez. The Council agreed to the following amendment as discussed in the Public Hearing first above. Item 3 -3000 Cumberland: Council directed that this property remain on the demolition order and if in forty-five (45) days somebody applies for a permit and can provide Code Enforcement and Legal Department with a title policy as proof of property ownership they can be issued a Restoration Permit, contingent upon the taxes being brought current before any permit is issued. Within 45 days from permit issuance they must show substantial progress in bringing that property in compliance with Code regulations and within sixty days after the 45 days they must obtain a Certificate of Occupancy, otherwise, if these time lines are not met the property will be demolished. Motion carried by the following vote. 753 Item 8a continued Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Norrie, Gonzalez, and Elmore Nays: None Mayor moved Item 8d up to be discussed at this time. Item 8d ORDINANCE NO.23 -2006 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ESTABLISHING CHAPTER 78, ARTICLE V OF THE CODE OF ORDINANCES TO PROVIDE A SAFETY ZONE SURROUNDING SCHOOLS, CHILDCARE FACILITIES, YOUTH CENTERS, AND PARKS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Roberts-Burns that Ordinance No. 23-2006 be passed. Motion seconded by Councilor Elmore. A lengthy discussion ensued regarding the entire Ordinance and grandfathering issue. Moved by Councilor Norrie to amend proposed ordinance that one year limitation be given for sexual offenders to move outside the 1000 foot distance. Motion seconded by Councilor Ammons and failed by the following vote: Ayes: Councilor Norrie Nays: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Gonzalez, and Elmore Alan Ballard, Executive Director for Child Advocates, expressed concern about a false sense of security and the actual real number of sexual predators. He felt that adults need to be more educated so that they in turn can educate their children. He gave education program suggestions to better educate kids to defend themselves. He suggested programs through the Parks and Recreation Department. Trish Remington, Executive Director of Patsy's House, commended Council for looking into this and for what they are doing. She mentioned grandfathering and how there are predators who do not register and suggested that this be kept in mind. She also mentioned concern about giving a false sense of security. Main motion carried by the following vote. Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Norrie, Gonzalez, and Elmore Nays: None City Council recessed at 11:35 a.m. and reconvened at 11:45 a.m. Item 8b ORDINANCE NO. 21-2006 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, REZONING A PORTION OF 1020 CENTRAL FREEWAY, LOT 17-A, B. B. WOODALL SUBDIVISION, FROM RESIDENTIAL MIXED USE TO GENERAL COMMERCIAL ZONING; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Ginnings that Ordinance No. 21-2006 be passed. Motion seconded by Councilor Elmore and carried by the following vote. 754 Item 8b continued Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Norrie, Gonzalez, and Elmore Nays: None Item 8c ORDINANCE NO. 22-2006 ORDINANCE CLOSING, VACATING, AND ABANDONING THE RIGHT-OF-WAY OF KEITH STREET LYING BETWEEN LAWRENCE ROAD AND THE FORT WORTH AND DENVER RAILROAD; AUTHORIZING THE CONVEYANCE OF THE PROPERTY TO THE FEE OWNER; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Roberts-Burns that Ordinance No.22 -2006 be passed. Ayes: Mayor Lyne, Councilors Ginnings, Ammons, Roberts-Burns, Norrie, Gonzalez and Elmore Nays: None Item 8e ORDINANCE NO. 24-2006 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING ORDINANCE 25-2005 AT SUBSECTION 5.01, ENTITLED RIGHTS-OF-WAY FEE, TO UPDATE THE MONTHLY FEE FOR ACCESS LINE RATES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW Moved by Councilor Roberts-Burns that Ordinance No. 24-2006 be passed. Item 10b Councilor Elmore stated it is his desire that the City of Wichita Falls be the friendliest city in America but it is not. I would like to see a "How can I help you" attitude. I want us to be friendlier with everyone, citizens, Sheppard Air Force Base, visitors, etc. Citizens are calling me and they are having significant problems with City Staff. Councilor Ginnings referenced the Park Board minutes regarding the YMCA agreement that it needs to be solved before next summer. What needs to be solved? Some want all the contracts to be the same. The Y is unique. I did not expect all the contracts to be the same. I am not saying we should not look into this Councilor Ginnings encouraged voters to get out and vote and to talk about voting. Mayor Lyne told Mr. Ginnings that they are looking at those contracts for 2007. They are trying to make them more consistent. Councilor Norrie challenged citizens to speak with some folks about it because some of your information is incorrect in reference to the YMCA. 757 Item 10b continued Councilor Norrie was glad they had talked about the sexual offender issue and glad they passed that Ordinance to protect children. Councilor Gonzalez was also glad they passed that Ordinance with the 1000 foot limitations. It was a good discussion and we were reasonably able to agree on.that. He was glad they passed something that we can begin with. Councilor Ammons informed that Youth Leadership would hold a mock City Council meeting April 11 at 6:30 p.m. in Council Chambers. Councilor Ammons also reminded everyone about the dog parade April 8 at Weeks Park Lane and Granada at 9:00 a.m. Mayor informed that our website has a link to obtain sexual offender information. Items 11 a-11 b City Council went into Executive Session at 12:55 p.m. as authorized by Section 551.071 and 551.072 of the Texas Government Code. City Council reconvened at 2:10 p.m. Mayor announced that no votes were taken during Executive Session. City Council adjourned at 2:10 p.m. PASSED AND APPROVED this day of , 2006.
