" � RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TX., AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH URS CORPORATION FOR CONSTRUCTION QUALITY ASSURANCE TESTING AND RESIDENT PROJECT REPRESENTATIVE (RPR) SERVICES IN CONJUNCTION WITH THE TAXIWAY "C" PROJECT AT WICHITA FALLS MUNICIPAL AIRPORT; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls has awarded a contract for Taxiway "C" Rehabilitation work at Wichita Falls Municipal Airport; and WHEREAS, the City of Wichita Falls desires construction Quality Assurance Testing and Resident Project Representative (RPR) services be performed in conjunction with the above referenced project; and WHEREAS, Federal Aviation Administration will fund 95% of cost of these services and sufficient Wichita Falls Municipal Airport money is available to fund the additional 5% of the service agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Manager is hereby authorized to execute the attached agreement supplement with URS Corporation for construction Quality Assurance Testing and Resident Project Representative (RPR) services in conjunction with the Taxiway "C" Rehabilitation Project at Wichita Falls Municipaf Airport in the amount of $66, 782.37. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. The WORK to which this ORDER applies is Resident Projcet Representation (RPR) and Acceptance Testing Services for the Taxiway C Rehabilitation Project at the Wichita Falls Municipal Airport. The ENGINEER shall, in the scope of their work, perform the following basic services for the WORK: I. RESIDENT PROJECT REPiZESENTATION A. GENERAL The Resident Project Representative (RPR) as the Engineer's agent, will act as directed by and under supervision of the Engineer, and will confer with the Engineer regarding the RPR's nctions. The RPR's dealings in matters penaining to the on-site work shall in general be only with the Engineer and the Contractor, keeping the Owner/Sponsor advised as necessary, and dealings with the subcontractors shall only be through or with the full knowledge of the Contractor. Written communicarions with the OwnedSponsor will be only through or as directed by the Engineer. B. DUTIES ANU RESPONS[BILITtES OF THE RPR The RPR shall: I. Be thoroughly familiar with the plans and specifications as they apply to the work being inspected, and review them frequently. The RPR must be capable of immediately recognizing if the work conforms to the contract requirements. 2. Provide full Ume services at all times the Convactor conduc[s ac[ivities on the construcuon site. 3. Serve as the Fngineer's tiaison with the Con[ractor, working principally through the Contractor's superintendent and assist in understanding the intent of the Contract Documents, and assist the Engineer in serving as thc Owner's liaison with the Contractor particulazly when the Contractor's operations affect che Owner's on-site operations. 4. Review the progress schedule, samples schedule of Shop Drawing submittals and schedule of values prepared by thc Contractor and consult with the Engineer as to the acceptability of such xhedules. A-1 5. Act as the Engineer's Liaison: i) Attencllconduct meetings with the Engineer, Owner and Contractor, such as Pre- Conswction Conferences, progress meetings, weekly construction coordination meetings, job conferences and other project-rolated meetin�s, and prepare and circulate copies of minutes thereof. ii) assist in obtaining from the Owner additional details or information, when required for proper execution of the Work. 6. Collect and uansmit Shop Drawings and samples: i) record date of receipt of Shop Drawings and samples. ii) receive samples which are furnished at the site by the Contractor, and notify the Eogineer of the availability of samples for examination. iii) advise the Engineer and Contractor of the commencement of any Work requiring a Shop Drawing or sample if the submittal has not been approved by the Engineer. 7. Review, rejection and correction of defective work, inspection and testing: i) observe, review and test the Work tfiroughout the conswction administration phase, as needed, to determine if the Work is proceeding in accordance with the Co�lract Documents. ii) reject, require correction, or uncovering of the Work for observation, or require special testing, inspection or approval of the Woric that in the opinion of the RPR dces not confortn to the Contract Documents or is defectivc, unsatisfactory, or faulty, and notify lhe Engineer and Owner in writing of che reason for each such rejection, correction, and uncovering. The RPR shall eva(uate, if requested by the Owner, the impact of each such rejection, co►rection, and uncovering of the Work on the Contractor's scheduling. iii) verify that tests, equipment and systems startups and operating and maintenance training are conducted in the presence of appropriate personnel, and that the Contractor maintains adequate records thereof; and observe, rccord and report lo thc Engineer appropriate details relative to the test procedures and startups. iv) accompany visiting inspectors representing public or other agencies having jurisdiction over the Praject, record the results of these inspections and report to the Engineer. 8. Maintain at the job site orderly files for correspondence, reports of job conferences, Shop Drawings and samplcs, reproductions of original Contract Documents, including all Work Dircctive Changes, Addcnda, Changc Orders, Field Orders, additional drawings issucd A-2 subsequent to the execution of the ConVact, Engineer's clarifications and interpretations of the Contract Documents, progress reports, and other project rclated documents. 9. Keep a diary or log book, recording Contractor hours on the job site, weather wnditions, data relative to questions of Work Directive Changes, Change Orders or changed conditions, list of job site visitors, daily activities, decisions, observations in general, and specific obscrvations in more detail as in the case of observing test procedures, send copies to the Engineer, and provide copies to the Owner upon request. 10. Record names, addresses and telephone numbers of all subcontractors and major suppliers of materials and equipment. l l. Fumish the Engineer with weekly reports as required of progress of the Work and of Contractor's compliance with the progress schedule of Shop Drawings and sample submittals. 12. Consult with the Engineer in advance of scheduled major tests, inspections or start of important phases of the Work. i) draft proposed Change Orders and Work Directive Changes, obtaining backup material from the Contractor and recommend to the Enginecr Change Orders, Work Directive Changes, and Fietd Orders. 13. Report immediately to the Engineer and Owner upon occurrence of any accident. 14. Review applications for paymcnts with the Contractor for compliance with the established procedure for their submission and forward the recommendations to the Engineer, noting particularly the relationship of the payment requested to the schedule of values, Work completed, and materials and cquipment delivered at the site but not incorporated into the Work. The Engineer shall [hen detertnine the amount owing to the Contractor and shall certify requests for payment in such amounts, on the basis that the Work has progressed to the point indicated and that the quuliry of the Work is in accordance with the Contract Documents. C. i.IMiTATIONS OF THF. RPR'S AUTHORITY The Resident Project Representative: l. Shall not authoriu any deviation from the Contract Documents or substitution of materials or equipment, unless authorized by the Engineer. 2. Shall not exceed the limitations of the Engineer's authority as set forth in the Contract Documents and the Agreement. 3. Shall not undertake any of the responsibilities of the Convactor, subcontractors, or Contractor's superintendent. A-3 4. Shall not advise on, issue directions relative to or assume control over any aspect of the means, methods, techniques, sequences or procedures of construction unless such advice or directions are specifically required by the Contract Documents. 5. Shall not advise on, issue directions regarding, or assume control over safety precautions and programs in connection wi[h tfie Work. However, the RPR shall notify the Contracwr, the Engineer, and the Owner of any safery concems the RPR may have, whether such matters relate to the Contractor, or the Contractor's subcontractors or suppliers. Sucfi notice shall be immediate and when possible frorn the project site in order to allow, among other things, the Owner the opportunity to have safe conditions for its employees. 6. Shall not accept Shop Drawings or samples from anyone other than the Contractor. II.
