Ordinance closing and abandoning an alley approximately .0123
acres between 1705 Grace St., 1525 17 th St., 1527 17th St., 1524 Kell
W. Blvd., and 1707 Grace St., a tract of land out of Block 5 , H.W.
Spivey Addition, Wichita County, Wichita Falls, Texas, which
consists of approximately 5,341 square feet, more or less, as
depicted and indicated on the attached plat map
WHEREAS, Ty Smith, property owner of 1707 Grace St. and 1524 Kell W. Blvd.,
Wichita County, Wichita Falls, Texas, has requested to close and abandon said alley
located between 1705 Grace St., 1525 17 th St., 1527 17th St., 1524 Kell W. Blvd., and
1707 Grace St., Block 5, H.W. Spivey Addition, Wichita County, Wichita Falls, Texas;
and,
WHEREAS, all affected utility companies, City departments and adjacent
property owners have reviewed this request, and all but 2 property owners have
recommended conditional approval to close and abandon this alley upon retention of all
utility easements; and,
WHEREAS, it has been determined to be in the best public interest to close and
abandon said alley as herein indicated on the attached Location Map.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The approximately 5,341 square feet, more or less, alley located between
1705 Grace St., 1525 17th St., 1527 17th St., 1524 Kell W. Blvd., and 1707
Grace St., as indicated on the attached Location Map, an addition to the City of
W ichita Falls, is hereby closed and abandoned.
2. In consideration of the receipt of $21,364.00 for the cost of the property, this
ordinance shall approve the closure of the alley and retain the util ity easement.
3. It is hereby officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.
1. This will authorize the City Manager to execute a quitclaim deed to convey the
property with retention of all utility easements.
