Res 117-2007 7/17/2007 RESOLUTION NO. 117-2007 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, TO APPROVE AN AGREEMENT WITH ONCOR ELECTRIC DELIVERY COMPANY TO RELOCATE A PORTION OF THE EXISTING OVERHEAD AND UNDERGROUND DISTRIBUTION FACILITIES FOR CONSTRUCTION OF DRAINAGE IMPROVEMENTS WITHIN THE MAPLEWOOD EXTENSION PROJECT BETWEEN KEMP BOULEVARD AND LAWRENCE ROAD; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls is required under the franchise agreement with Oncor Electric Delivery Company to bear the cost to relocate electric utilities to facilitate the construction of drainage projects; and WHEREAS, relocation work will be performed by Oncor Electric Delivery Company; and WHEREAS, the City shall pay Oncor Electric Delivery Company for its cost incurred that is estimated to be $145,787.00; and WHEREAS, Staff has reviewed and is recommending the Agreement with Oncor Electric Delivery Company; and WHEREAS, the Council has examined the proposed Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The proposed Agreement with Oncor Electric Delivery Company for electric utility relocations to facilitate the construction of the new Maplewood Ave. and Drainage Project is hereby approved. The City Manager is authorized to execute the Agreement for the City of Wichita Falls and to make a payment of $145,787.00 to Oncor Electric Delivery Company. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 17th day of July, 2007.
