Res 108-2007 7/3/2007 RESOLUTION NO. � �� RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ACCEPTING THE 2005 BUDGET UTILITY IMPROVEMENT PROJECT, CWF05-550-19, AND AUTHORIZING FINAL PAYMENT TO WALKER CONTRACTING, INC.; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls entered a unit price contract with Walker Contracting, Inc., with an estimated total cost of $733,557.00; and WHEREAS, the actual work was completed at a total cost of $765,122.25 of which $710,939.81 has been previously paid to the contractor. A total (9) days of Liquidated Damages will be applied to this contract at $240.00 per day for a total of $2,160.00 for project completion delays. This leaves a total amount due of $52,022.44; and WHEREAS, City Staff has inspected the work and found it to be acceptable. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The 2005 Budget Utility Improvement Project, CWF05-550-19, is hereby accepted, and the City Manager is authorized to make final payment to the contractor. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 3rd day of July, 2007.
