RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, ACCEPTING THE JASPER WATER TREATMENT
PLANT REHABILITATION AND IMPROVEMENTS CWF04-544-21, AND
AUTHORIZING FINAL PAYMENT TO EAGLE CONTRACTING L.P.;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a lump price contract with Eagle
Contracting, L.P. with the estimated total cost of $18,840,000.00; and,
WHEREAS, the actual work was completed at a total cost of $20,025,974.24 of
which $19,825,714.50 has been previously paid to the contractor, leaving an amount
due of $200,259.74; and,
WHEREAS, the City staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Jasper Water Treatment Plant Rehabilitation and
Improvements Project, CWF04-544-21 is hereby accepted, and the City Manager is
authorized to make final payment to the contractor.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
