Ord 8-2002 1/15/2002f 4 ORDINANCE NO. Z— ORDINANCE REZONING A 1.622 ACRE TRACT OF LAND OUT OF BLOCK 10, DENTON COUNTY SCHOOL LANDS, ABSTRACT 58, WICHITA COUNTY TEXAS, FROM SINGLE FAMILY -1 TO CONDITIONED GENERAL COMMERCIAL AND AMENDING THE COMPREHENSIVE PLAN; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the owner of a 1.622 acre tract of land desires to rezone such tract; and, WHEREAS, the City Council finds that this rezoning request is in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City of Wichita Falls Land Use Plan, an element of the Comprehensive Plan for the City of Wichita Falls, Texas is hereby amended for the 1.622 acres out of Block 10, Denton County School Lands, Wichita Falls, Texas. Said property is shown on the attached map, incorporated in this ordinance as Attachment "A." Said property land use designation shall be changed from Residential to Commercial. SECTION 2. Said property being the same as described in Section 1, is hereby zoned General Commercial Conditioned zoning, and regulated as follows: GENERAL COMMERCIAL CONDITIONED ZONING DISTRICT GC(c) A. The following uses are permitted in the GC(c) district: Residential Uses Dwelling, Duplex, Two - Family Dwelling, Single - Family Detached Group Home B. The following uses are permitted in the GC(c) district subject to the Site Plan review provision of Section 7100 of the Zoning Ordinance: Residential Uses - Condominium, Residential - Dwelling, Multifamily - Dwelling, Zero Lot -Line, Single Family - Townhouse - Convalescent Service Civic Uses - Day Care Center, Limited and Commercial Library, Public - Parks r - Public Safety Service Religious Assembly School, Primary and Secondary Commercial Uses - Art Gallery and Museum - Clinic - Convenience Store - Medical Office - Office - Restaurant - Retail Trade - Shopping Center The following are permitted in the GC(c) District subject to the conditional use approval process provided in Section 7200- - Alcoholic Beverage Sales - Business and Trade School - Movie Theater - Nursery - Hospital - Hotel - Indoor Sports and Recreation - Services Note: The development regulations for this General Commercial Conditioned district shall be the same as the General Commercial Zoning District, Section 3490 of the Zoning Ordinance. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
